TERMINATION OF LICENSE FOR THE HEMATITE SITE IN FESTUS, MISSOURI (NRC LICENSE NO. SNM-00033)

Dear Mr. Stalcup:

I am writing to inform you of the termination of the U.S. Nuclear Regulatory Commission (NRC) special nuclear materials (SNM) license for the Hematite facility in Festus, Missouri (License No.

SNM-33). The NRC staff completed the review of Hematites final status survey (FSS) reports for the remediated portions of the site, and the data in the FSS reports demonstrated that the site met the radiological criteria for unrestricted use in 10 CFR Part 20, Subpart E. The NRC terminated the license for the Hematite facility on September 26, 2018 (Agencywide Documents Access and Management System [ADAMS] Accession No. ML18256A186).

In a letter dated February 22, 2011 (ADAMS Accession No. ML110420275), the NRC notified the U.S. Environmental Protection Agency (EPA) that the decommissioning plan (DP) for the Hematite site contained Derived Concentration Guideline Levels (DCGLs) (i.e., cleanup levels) that exceeded the consultation trigger values from Table 1 of the Memorandum of Understanding (MOU) entitled Consultation and Finality on Decommissioning and Decontamination of Contaminated Sites dated October 9, 2002 (ADAMS Accession No. ML022830208). The consultation letter (termed a Level 1 consultation by NRC) also stated that we would review Hematites FSS reports following completion of site remediation, and initiate a second consultation, as discussed in Section V.C.2 of the MOU (termed a Level 2 consultation),

if the actual residual soil contamination levels exceeded the consultation trigger values in Table 1 of the MOU.

The NRC staff reviewed the radiological data in the FSS report and compared the residual radioactivity levels to the trigger values in Table 1 of the MOU. No FSS measurements exceeded the trigger levels of the MOU. Therefore, we have concluded that a Level 2 consultation under the MOU is not necessary.

During the site decommissioning process, the NRC conducted a number of onsite inspections of Hematites actions to verify that the cleanup was being conducted as described in the DP. The NRCs contractor, Oak Ridge Associated Universities, also performed independent measurements and sample analysis to verify Hematites FSS results and concluded they were consistent with Hematites FSS data. Based on these actions and the NRCs review of the FSS data, the NRC has concluded that: (1) decommissioning activities were performed in accordance with the approved DP; (2) the FSS data were collected and evaluated consistent with the MARSSIM guidance; and, (3) the FSS data and the NRCs contractors independent
