TERMINATION OF THE U.S. NUCLEAR REGULATORY COMMISSION SOURCE MATERIALS LICENSE NO. SNM-00033 FOR THE HEMATITE SITE IN FESTUS, MISSOURI

Dear Mr. Kelmeckis:

By letter dated December 20, 2017, the U.S. Nuclear Regulatory Commission (NRC) received a request from Westinghouse Electric Company, LLC (Westinghouse) to terminate NRC Special Nuclear Materials (SNM) License No. SNM-00033 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML17355A043). In this request, Westinghouse stated that it has completed decommissioning and decontamination of the Hematite facility located at 3300 State Road P, Festus, Missouri, in accordance with its approved Decommissioning Plan (DP) (ADAMS Accession No. ML112101699).

On the basis of decommissioning activities carried out by Westinghouse, the NRC evaluation of the Final Status Surveys and Final Status Survey Report (FSSR), combined with the results of NRCs independent and confirmatory surveys, and on-site inspections, the NRC staff concludes that the site radiological levels are consistent with the provisions of Title 10 of the Code of Federal Regulations (10 CFR) Part 20, Standards for Protection Against Radiation, section 20.1402, Radiological criteria for unrestricted use. As such, we consider the site acceptable for unrestricted use, and License No. SNM-00033 is hereby terminated. A safety evaluation report documenting the NRC staffs review of Westinghouses remediation activities and FSSR of the Hematite site is enclosed. This SER, coupled with Westinghouse providing NRC form 314 and the records required by 10 CFR 70.51(a), documents that the requirements of 10 CFR 70.38(k) have been satisfied.

The NRC staff reviewed the FSSR, and compared the residual contamination levels to the trigger values for soil and groundwater in the Memorandum of Understanding between the U.S.

Environmental Protection Agency [EPA] and the U.S. Nuclear Regulatory Commission; Consultation and Finality on Decommissioning and Decontamination of Contaminated Sites.

The staff concluded that the trigger levels for soil and groundwater were not met or exceeded.

Thus, in accordance with Section V.C.2 of the MOU, consultation with the EPA is not required.

V. Kelmeckis In connection with the license termination, Westinghouse may request that the NRC release the decommissioning funds set aside for the Hematite Site.

Also, enclosed is a copy of the Notice of License Termination, which is being sent to the Office of the Federal Register for publication.

In accordance with 10 CFR Part 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of NRCs ADAMS. ADAMS is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html.
