The U.S. Nuclear Regulatory Commission (NRC) is a beneficiary to the Trust Agreement dated December 30, 2016 (Agencywide Documents Access and Management System (ADAMS)

Accession Number ML17019A396), between Westinghouse Electric Company LLC (Westinghouse) and the Bank. Westinghouse established this Trust Agreement to comply with decommissioning funding regulations in Title 10 of Chapter I of the Code of Federal Regulations (10 CFR) Parts 40 and 70. This Trust Agreement has been established for two facilities:

Westinghouse Hematite (Hematite), NRC License Number SNM-33, and Westinghouse Columbia Fuel Fabrication Facility, NRC License Number SNM-1107.

On September 27, 2018, NRC terminated the Hematite license following completion of the radiological cleanup of the Hematite site to unrestricted release criteria (ADAMS Accession Number ML18256A186). On October 10, 2018, Westinghouse requested the NRC to release the funds reserved for the Hematite site, (ADAMS Accession Number ML18346A601). Since the Hematite license has been terminated, NRC no longer requires Westinghouse to maintain decommissioning funding for the site. In accordance with Section 5 of the Trust Agreement, by this letter the NRC directs the Bank to return the funds associated with the Hematite site, plus any accrued income attributed to these funds to Westinghouse. The NRC is not directing any action with regard to the decommissioning funding for Columbia Fuel Fabrication Facility.

Finally, in connection with its request for the release of funds for Hematite, Westinghouse requested Amendment Number 1 (see enclosure) to the Trust Agreement in order to remove references to the Hematite facility. In accordance with Section 15 of the Trust Agreement, the NRC has found that Amendment Number 1 meets the relevant regulatory requirements of the NRC and approves Amendment Number 1. The original copy of Amendment Number 1 signed by the NRC and Westinghouse is enclosed.
