ASLBP No. 07-858-03-LR-BD01 (Indian Point Nuclear Generating Units 2 and 3) April 11, 2013 ORDER (Granting Entergys Motion for an Extension of Time and for Leave to File Replies)

On April 9, 2013, Entergy Nuclear Operations, Inc. (Entergy) filed (1) motions for leave to file replies to certain arguments in the responses of the State of New York (New York) and Riverkeeper, Inc. (Riverkeeper) to Entergys motion for a declaratory order concerning the Coastal Zone Management Act; and (2) an unopposed motion seeking an extension of time to file its answer to New Yorks cross-motion for a declaratory order.1 No party opposed the motion for extension of time; New York and Riverkeeper oppose the motions to file replies.2 On April 10, 2013, New York filed an opposition to Entergys motion, arguing that Entergy has not demonstrated that compelling circumstances exist to overcome the general prohibition on replies, and that Entergy could have reasonably anticipated New Yorks 1

arguments concerning jurisdiction and mootness.3 Riverkeeper also filed an opposition to Entergys motion in which it also argued that Entergy failed to demonstrate that compelling circumstances exist to overcome the general prohibition on replies.4 Good cause having been shown,5 we grant Entergys motion for an extension of time to file its answer to New Yorks cross-motion. Additionally, because the issues raised by Entergys motion are novel and complex, we are of the opinion that the limited replies proposed by Entergy may be helpful to the Boards adjudication of these issues. Accordingly, we grant Entergys motions to file replies with the following modification: Entergy shall submit its combined answer and replies in a single filing on April 22, 2013.
