On August 7, 2006, the U.S. Department of Transportation (DOT), Maritime Administration(MARAD) submitted a request to amend License No. NS-1 for the N.S. SAVANNAH. The license amendment request included two attachments. Attachment A provided a summary of the security considerations supporting three of the five proposed Technical Specification changes. MARAD requested that the U.S. Nuclear Regulatory Commission (NRC) withhold Attachment A from public disclosure as confidential material in accordance with 10 CFR 2.390.MARAD's request to withhold Attachment A from public disclosure is accompanied by anaffidavit that: (1) identifies the document to be withheld; (2) identifies the official position of the Senior Technical Advisor and Manager, N.S. SAVANNAH Programs; (3) declares the basis for proposing the information to be withheld; (4) includes a specific statement of the harm that would result if the information to be withheld is disclosed to the public; and (5) indicates the location in the document of all information sought to be withheld.The staff has reviewed MARAD's request to withhold Attachment A from public disclosure anddetermined that: (1) the consolidated discussion of security issues contained in Attachment A has been held in confidence; (2) the consolidated discussion of security issues is the type of information normally held in confidence by MARAD; (3) Attachment A was transmitted to and received by the NRC in confidence; and (4) there is no single document available to the public which contains the consolidated discussion of security issues for the N.S. SAVANNAH. Therefore, Attachment A, marked as confidential, will be withheld from public disclosurepursuant to 10 CFR 2.390(b(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended. Withholding from public disclosure shall not affect the right, if any, of persons properly and directly concerned to inspect the documents.
