LICENSE EXPIRATION DATE (TAC No. L31070)

Dear Dr. Mailer:

In response to your letter dated April 24, 1998. the staff has reviewed Special Nuclear Material License SNM-589 to determine if you meet the requirements of 10 CFR 70.38(a)(2) allowing an extension of the license expiration date.

The staff has determined that:

1. A criticality monitoring system is not required in accordance with 10 CFR 70.24 because the subcritical assembly cannot be made critical for all foreseeable water-fuel mixtures, as documented in the Safety Evaluation Report for renewal dated November 15. 1993.
2. An evaluation or an emergency plan is not required in accordance with 10 CFR 70.22(i). because the licensee is exempted from the requirement for a criticality monitoring system in 10 CFR 70.24:
3. The licensee is not subject to the financial assurance requirements of 10 CFR 70.25. because the material authorized in the license (900 aluminum-clad.

5. The renewal of License SNM-589 meets the categorical exclusion requirements of 10 CFR 51.22(c)(14), and therefore neither an environmental assessment nor environmental impact statement is required; and
6. The licensee was inspected before February 15. 1996. and the inspection did not result in the citation of any violations or in issuance of any orders or )f;!

confirmatory action letters.

Therefore. the staff has determined that the requirements of 10 CFR 70.38(a)(2) have been met, and License SNM-589 shall be deemed to have an expiration date five years after the expiration date of the current license. Therefore, the license expires on November 50, 2003. Please note that the NRC Region IV inspection staff was contacted and has no objection to this licensing action. A copy of License SNM-589 is enclosed.

the license for a period of 24 months. However, because your license was renewed in 1993 to authorize only storage of this material, you are not subject to the Timeliness Rule provisions of 10 CFR 70.38(d)-(i). Nevertheless, the NRC encouNges you to continue working with the Department of Energy for timely transfer of your special nuclear material so that you may complete final decommissioning of your facility.
