I am writing regarding your December 5, 2023, submittal on behalf of Beyond Nuclear, Michigan Safe Energy Future, and Dont Waste Michigan (Agencywide Documents Access and Management System (ADAMS) Accession No. ML23339A192). As noted in our December 18, 2023, response (ML23352A325), Contention 2 of your submittal, alleging that Holtec misused decommissioning funds, has been referred to the 10 C.F.R. § 2.206 petition process (ML23352A325). This process provides that any person may file a request to institute a proceeding pursuant to § 2.202 to modify, suspend, or revoke a license, or for any other action as may be proper.

Following evaluation in accordance with Section II.A.2.(c) of NRC Management Directive (MD) 8.11 Review Process for 10 CFR 2.206 Petitions (ML18296A043), the NRC staff has concluded that there is no imminent safety concern that warrants immediate action. The NRC staff has also concluded that your submittal has screened into the 2.206 process in accordance with Section II.A.2(a) of MD 8.11 and a Petition Review Board (PRB) will begin evaluating your concern for acceptance in accordance with Section III.C of MD 8.11. I have been appointed Petition Manager for the evaluation of your submittal and will keep you informed of the status as the PRBs review progresses.

As the PRB undertakes its evaluation, I would like to make you aware that because the 2.206 petition process is a public process, the submittal and all information contained therein, including your identity, will be made public. Please feel free to contact me with any questions about the process and/or the status of the PRBs evaluation at any time.
