Post Acceptance/Abeyance Process for the 10 CFR 2.206 Petition on Palisades Misuse of Decommissioning Trust Fund

Dear Wallace Taylor and Terry Lodge:

NRC Office Directors involved with Palisades decommissioning and potential re-start have concurred with the Petition Review Boards (PRB) recommendation to accept and to be held in abeyance your petitions concern regarding the Holtec misuse of decommissioning funding in CY 2023, expressed during the April 10 public meeting. Specifically, this concern is being accepted into the 2.206 process (MD 8.11 Section III.C.1) and will be held in abeyance (MD 8.11 Section III.C.3) pending the outcome of the NRC staff review of the 2023 decommissioning finding use.

The PRB is preparing a formal Acknowledgement Letter describing this recommendation which will be issued within the next several weeks. During the abeyance period, I will keep you informed as necessary of the NRC staff progress. Once the NRC staff has completed its review of the 2023 funding use, the PRB will reconvene to consider whether enforcement action is warranted. This decision by the PRB will be documented in Proposed Directors Decision which will be sent to you for comment before issuance of the Final Directors Decision.
