On May 8, 1981, this Commission issued its Order No.81-331 whereby the Commission ordered the hearir.g in the instant docket to conmence on t'onday, July 13, 1981, at 11: 00 A.fl.

In the offices of the Commission.

Thereafter, on May 13, 1981, the Intervenors, Fairfield United Action and John C. Ruoff, moved the Commission for a " modest continuance" of the commencement of the hearing scheduled in this matter to a date af ter July 24, 1981. It appears that the Atomic Safety and Licensing board of the United States Nuclear Regulatory Commission will be conducting a second phase of hearings regarding the licensing of the V. C.

Summer Nuclear Plant at that time.

On May 22, 1981, Scuth Carolina Electric and Gas Company (hereinaf ter "the Company") filed an Answer to the Intervenor's Motion for Continuance. The Company also requested the Commission to continue the hearing in the instant docket given the absolute need to maintain the current licensing schedule for the V. C. Summer Plant.

The Commission believes it is of the utmost importance that the Atomic Safety and Licensing Board (ASLB) hear and dispose of issues concerning the licensing of the Virgil C.

The Commission notes, however, that dates for its hearings are set without consulting applicants, petitioners or intervenors.

The mair criteria used in scheduling a case are:

a) complexity of case; b) estimated length of time to hear case; c) number of cases to be hcard; d) time available to Commission and staff.

The present schedule and case load confronting the Commission will out of necessity permit the instant rate case to be heard no longer than through August 28, 1981.

1. That the hearing previously scheduled in this matter be rescheduled to commence in the officen of the CorJni S S ion , 111 Doctors Circle, Columbia, South Carolina, on Monday, July 27, 1981, at 11:00 A.!1.

AFFIDAVIT OF MARY ELLEN R. WESTMORELAND My name is Mary Ellen R. Westmoreland. I live at Route 2, Box 125, St. Matthews, South Carolina. I am employed as a secretary by Palmetto Alliance, Incorporated, 2135 Devine Street, Columbia, South Carolina.

On Ap'ril 10, 1981, I typed and mailed for Mr. Michael Lowe, a staff member of Palmetto Alliance, a letter to the Hon. Thomas F. Hartnett and the same letter to other members of the Congressional delegation from j South Carolina inquiring about a letter which the delegation had sent l

] to the Hon. John F. Ahearne of the Nuclear Regulatory Commission on 1

February 19, 1981.

4 Among other things, the letter to Representative Hartnett asked for "the name and organizational affiliation of the person or persons who pre-pared your request to former Commissioner Ahearne or the underlying infor-mation."

Shortly thereafter, Mr. Lowe received a letter from Representative Hartnett responding to Mr. Lowe's letter of April 10. That letter indicated that South Carolina Electric and Gas Company and South Carolina Public Service Authority representatives had contacted him concerning the operating license for the Sumer facility. A copy of that letter is attached to this affidavit and marked Attachment C.

Thank you for your letter of recent date.

I was contacted several weeks ago by officials of South Carolina Electric and Gas, the majority owner, and the South Carolina Public Service Authority, the minority owner of the V.C. Summer Nuclear Station concerning the operating license for the aforementioned facility. As a proponent of nuclear power as an interim form of energy, I am concerned about the approximate S20,000,000 per month that it will cost the already overburdened consumers of our state.

As a member of Congress, one of my priorities will be to see that this great country of ours will be able to meet its energy needs for the future.
