BEFORE THE PUBLIC SERVICE COP 911SSION OF SOUTH CAROLINA DOCKET NO. 81-72-E - ORDER NO.81-331 May 8, 1981 IN RE: Application of South Carolint Electric ) ORDER-and Gas Company for Adjustments in the ) REQUIRING PREFILING Company's Electric Rate, Schedules and ) 0F TESTIMONY AND Tariffs ) SETTING HEARING AND CONFERENCE This matter is before the South Carolina Public Service Comission (nereinafter "the Comission").tgy way of the verified Notice and Application, dated and filed on February 27, 1981, by South Carolina Electric and Gas Company (hereinafter "the Company") whereby the Company soug.at certain relief in the nature of the approval of certain adjustments in the rates and charges for the electric services rendered by the Company subject to the jurisdiction of the Comission. The , Company's . Application notified the Comission that the adjusted rates and charges wt.re to be made effective for service rendered on and after April 1,1981, unless suspended by the Comission. The Company's Application for approval of the proposed adjustments in electric rates and charges was filed pursuant to S. C. Code Ann., S 58-27-860 (1976), and R.103-830 et sea. of the Comission's Rules and Regulations.

On Mar:;h 6,1981, the Comission issued its Order No.81-181 in the instant Docket, whereby the Comission, inter alia, suspended the operation of the Cornpany's proposed rates and charges for twelve months, pursuant to

5. C. Code Ann., S 58-27-870 (1976), until April 1,1982, unless a final decision in this proceeding is rendered prior to that date.I Order No.81-181 likewise expressed the Comission's determination that a public hearing should
be helo to evaluate fully the merits of the Company's Application, and further l

l indicated that the Comission would establish subsequently the date for the comencement of'such hearing.2 15 ee, Order No.81-239, issued on March 27, 1981, in the instant proceeding--whereby the Comission approved the Company's undertaking, dated i March 10,1981, which allowed the Company to place the suspended rates and i charges in effect for service rendered to its South Carolina retail customers on and after April 1,1981.

in the Offices of the Comission.

.0n Ap.11 8, 1981, the Comission issued its Order No.81-263, whereby

- the Comission directed the Company,to file with the Commission on or before May 13,1981, and serve on all parties of record, the testimony and exhibits of the witnesses which the Company intends to offer at the hearing in this proceeding.

In addressing the matter, of prepared testimony and exhibits in a formal proceeding, R.103-869C of the Comission's Rules and Regulations pro-vides, in c;rtinent part:

All parties of record, insofar as it is practicable, should pre-file with all other parties of re':ord copies of prepared statements and exhibits which the party of record proposes to use during a hearing.

In formal proceedings involving detailed and technical issues, the Comission may require any party and Staff to file copies of exhibits within a specified time in -

advance of hearing.

In previous proceedings, th? (cmission has generally acknowledged the practical difficulties which compliance with a rigid application of the pro-visions of R.103-869C may impose on various parties of record and on the Comission Staff. Consequently, the Comission has traditionally encouraged, rather Mn mandated, parties of record in complex, formal proceedings to-prefile and serve prepared testimony and exhibits.

In the instant proceeding, however, the Comission considers that the orderly and efficient administration of this proceeding will best be served by a requirement that the parties of record and the Comission Staff prefile with the Comission and serve on all parties of record the testimony and exhibits of the expert witnesses which such parties and the Commission Staff propose to offer to address the technical matters at issue herein.3 Such testimony should be filed and served on or before July 6.1981.

The Comission has further determined that the orderly, efficient

, and fair administration of this proceeding will be promoted by a conference of the parties of record prior to the commncament of the hearing. Accordingly, f

35uch issues will include, but not be limited to: cost of capitah mounting and pro forma adjustments to revenues, expenses or rate base i

components; the PURPA standards; and sales and demand fortcasting.

Pursuant to R.103-863 of the Comission's Rules and Regulations, we will designate the Comission's General Counsel as the Staff member before whom such confe ence is to be held.

The Comission will expect the subject matter of such conference to include the identification and scheduling of all witnesses intended to be offered by the parties of record. The Comission anticipates that the parties of record will be fully prepared to discuss procedural ist.as and any other pertinent matters at such conference. We,c,onsider that the orderly settlement of such issues will operate in the interests of all parties herein.

IT IS THEREFORE ORDERED:

1. That a hearing be, and hereby is, scheduled to be comenced in the instant proceeding in the offices of the Comission,111 Doctors Circle, Columbia, South Carolina, on Monday, July 13,1981, at 11:00 A.M.
2. That all parties of record and Comission Staff be, and hereby are, directed to file with the Comission and serve on South Carolina Electric and Gas Company and on all parties of record, the testimony and exhibits of technical or expert witnesses on or before July 6,1981; that, further, twenty-five (25) copies of such testimony and exhibits should be filed with the Com-mission.
3. That a conference of the parties of record in the instant pro-ceeding be, and hereby is, scheduled to be convened as hereinabove described in the offices of the Comission,111 Doctors Circle, Columbia, South Carolina, on Friday, July 10, 1981, at 10:30 A.M.
4. That this Order remain in full force and effect until further Order of the Comission BY ORDER OF THE COPNISSION:
