REVISED RESPONSE TO TASK INTERFACE AGREEMENT - DIABLO CANYON SEISMIC QUALIFICATION CURRENT LICENSING AND DESIGN BASIS, TIA 2011-010 (TIA 2012-012) (TAC NOS. ME9840 AND ME9841)
The purpose of this memorandum is to update the guidance found in Task Interface Agreement (TIA) 2011-010 dated August 1, 2011 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML112130655). TIA 2011-010 documents the Office of Nuclear Reactor Regulations (NRR) concurrence with Region IVs position that new seismic information developed by the Pacific Gas and Electric (PG&E, the licensee) is required to be evaluated against all three of the seismic design basis earthquakes at Diablo Canyon Power Plant (DCPP)1. After the issuance of TIA 2011-010, two additional documents have been issued that essentially supersede the guidance found in TIA 2011-010. These documents are:
* U.S. Nuclear Regulatory Commission (NRC) request for information dated March 12, 2012, that was sent to all nuclear power plant licensees pursuant to paragraph 50.54(f) of Title 10 of the Code of Federal Regulations (10 CFR)
(ADAMS Accession No. ML12053A340) requesting a reevaluation of seismic hazards .
* NRC letter to PG&E dated October 12, 2012 (ADAMS Accession No. ML120730106), that informed the licensee of the results of the review of the Shoreline fault, and placed the NRCs review of the Shoreline fault into context with the action for all nuclear power plant licensees to perform seismic reevaluations in accordance with the request for information dated March 12, 2012.
The NRC staffs current position regarding expectations for addressing new seismic information is documented in the request for information dated March 12, 2012, and the NRC letter to the licensee dated October 12, 2012. The staffs position that supersedes the guidance found in TIA 2011-010 is as follows:

Initiate rulemaking to require licensees to confirm seismic hazards and flooding hazards every 10 years and address any new and significant information. If necessary, update the design basis for systems, structures, and components important to safety to protect against the updated hazards.
Therefore, expectations related to collection and assessment of new seismic hazards information would likely be addressed as part of this response.
Based on the above, the NRC staff considers that the guidance found in TIA 2011-10 has been superseded by the guidance for assessing new seismic information at DCPP found in the NRCs letter dated October 12, 2012, and the request for information dated March 12, 2012.

REVISED RESPONSE TO TASK INTERFACE AGREEMENT - DIABLO CANYON SEISMIC QUALIFICATION CURRENT LICENSING AND DESIGN BASIS, TIA 2011-010 (TIA 2012-012) (TAC NOS. ME9840 AND ME9841)
