2 7.77 NOTICE OF APPEAL AND EXCEPTIONS In accordance with Section 2.762 of the Commission's Rules of Practice and Procedure, the City of Cleveland (City) appeals from the decision of the Atomic Safety and Licensing Board (Licensing Board) issued January 6,1977, in the above-entitled dockets with respect to the matters set forth in the City's statement of exceptions.

Statement of Exceptions

1. The Licensing Board erred in failing to provide that the licensing conditions should apply to any construction permit or operating license granted for Beaver Valley, Unit 2.
2. The Licensing Board erred in failing to impose license conditions requiring applicants to make available to non-applicant entities in the CCCT wholesale power including

condition 4(d) that new members joining CAPCO I

are not entitled to become voting members of CAPCO until such time as that system's capacity becomes equal to or exceeds the capacity of the amanest member of CAPCO which enjoys voting rights.

4. The Licensing Board erred in permitting the law firm Squire, Sanders and Dempsy and its Washington affil-late , Cox, Langford and Brown, to participate in these proceedings as counsel for the Cleveland Electric Hluminating Company (CEI).
5. The Licensing Board erred in adopting the ruling of the Special Master with regard to claims of attorney-client privilege.
