NOTICE OF APPEAL AND EXCEPTIONS In accordance with Section 2. 762 of the Commission's Rules of Practice and Procedure, the City of Cleveland (Cleveland) appeals from the Decision Of Special Board Established For 10 C. F.R. $2.713 Proceed-ing (Special Board), issued November 5,1976, in the above-entitled docket.

Cleveland makes the following statement of exceptions:

1. The Special Board erred in granting the Motion to Dismiss filed by Squire, Sanders and Dempsey and in dismissing Cleveland's motion to disqualify the law firm of Squire, Sanders and Dempsey and its Washing-ton, D. C. affiliate.

2. The Special Board erred in holding the doctrine of collateral estoppel was applicable to these proceedings. -

3. The Special Board erred in its application of the doctrine of collateral estoppel.

4. The Special Board erred in finding that there was an identity of parties in the proceedings before the United States District Court for the Northern District of Ohio, Eastern Division, and these proceedings.

5. The Special Board erred in finding that there was an identity of issues in the proceedings before the United States District Court for the Northern District of Ohio, Eastern Division, and these proceedings.

6. The Special Board erred in failing to conduct evidentiary hear-ings as required by the mandate of the Atomic Safety and Licensing Appeal Board in its decision of June 11, 1976, ALAB-332.
