Items of Interest Week Ending AUGUST 28, 2020 Staff Receives Subsequent License Renewal Application for North Anna Power Station, Units 1 and 2 On August 25, 2020, the U.S. Nuclear Regulatory Commission (NRC) received a subsequent license renewal (SLR) application from Virginia Electric and Power Company for the North Anna Power Station, Units 1 and 2. The current renewed licenses expire on April 1, 2038, for Unit 1 and August 21, 2040, for Unit 2. The staff plans to complete its safety and environmental reviews within 18 months after the application is accepted for review. Additional information regarding the SLR process and status of the North Anna Power Station, Units 1 and 2 SLR application review is available on the NRC public website at https://www.nrc.gov/reactors/operating/licensing/renewal/subsequent-license-renewal.html.

Staff Accepts Application Regarding a Digital Instrumentation and Control Modification at Waterford Steam Electric Station, Unit 3 On August 26, 2020, the NRC staff accepted for review Entergy Operations Inc.s license amendment request regarding a digital instrumentation and control (DI&C) modification at Waterford Steam Electric Station, Unit 3 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML20239B055). This DI&C license amendment request (ADAMS Accession No. ML20205L587) is the first submittal received in accordance with the Alternate Review Process guidance in NRCs DI&C Interim Staff Guidance-06, Revision 2 (ADAMS Accession No. ML18269A259). The NRC staff plans to complete its first-of-a-kind review within 1 year, notwithstanding any unforeseen complexities or challenges during the review.

Staff Issued Final Safety Evaluation Report for NuScale Small Modular Reactor On August 28, 2020, the NRC staff issued a final safety evaluation report for NuScales small modular reactor design (ADAMS Accession No. ML20231A804). This meets the agencys original 42-month technical review schedule and demonstrates the NRCs commitment to timely licensing of safe technologies for new, advanced reactors. The NRC is preparing a rulemaking to certify the design, that once completed, will allow a utility to reference the design when applying for a combined license to build and operate a nuclear power plant.

Staff Approved Licensing Requests for Regulatory Relief Related to the COVID-19 Public Health Emergency The NRC staff has reviewed and approved several licensing requests seeking temporary flexibilities to maintain the safe and secure operation of the U.S. nuclear fleet during the pandemic. A summary of approved licensing actions provided during this reporting period are summarized below. A complete list of licensing actions approved by the NRC in response to the COVID-19 public health emergency is available on the NRC public website at https://www.nrc.gov/about-nrc/covid-19/reactors/licensing-actions.html.

Items of Interest Week Ending AUGUST 28, 2020 Accident Source Term Methodologies and Corresponding Release Fractions: Petition for Rulemaking; Notification of Docketing and Request for Comment; Part 50 of Title 10 of the Code of Federal Regulations (10 CFR) (PRM-50-122; NRC-2020-0150)

On August 24, 2020, the U.S. Nuclear Regulatory Commission (NRC) published a notice of docketing and request for comment (85 FR 52058) for a petition for rulemaking (PRM) received from Brian Magnuson (petitioner) dated May 31, 2020. The petitioner requested that the NRC revise its regulations to codify the source term methodologies and corresponding release fractions recommended in a report issued by Sandia National Laboratories. The petition was docketed by the NRC on June 18, 2020, and has been assigned Docket No. PRM-50-122. The NRC is examining the issues raised in PRM-50-122 to determine whether they should be considered in rulemaking. The NRC is requesting public comment on this petition. Comments are requested by November 9, 2020.

Unified Agenda of Federal Regulatory and Deregulatory Actions; Semiannual Regulatory Agenda; 10 CFR Chapter I (NRC-2020-0052)

On August 26, 2020, the NRC published a document in the Federal Register (85 FR 52858) providing the NRCs semiannual regulatory agenda (the Agenda) in accordance with Public Law 96-354, The Regulatory Flexibility Act, and Executive Order 12866, Regulatory Planning and Review. The Agenda is a compilation of all rulemaking activities on which the NRC has recently completed action or has proposed or is considering action. Comments on the Agenda are requested by September 25, 2020.

Criteria for Development of Evacuation Time Estimate Studies; Draft NUREG; Request for Comment; 10 CFR Part 50 (NRC-2008-0122)

On August 27, 2020, the NRC published a document in the Federal Register (85 FR 52930) requesting public comment on a draft NUREG, NUREG/CR-7002, Criteria for Development of Evacuation Time Estimate Studies, Revision 1. This draft NUREG provides guidance to meet NRC requirements for development of evacuation time estimates to support emergency planning. The NRC plans to hold a public meeting to promote full understanding of the contemplated action and facilitate public comment. Comments are requested by October 13, 2020.

NMSS Staff Issue Exempt Distribution License On August 20, 2020, NMSS issued an exempt distribution license (Agencywide Documents Access and Management System (ADAMS) Accession No. ML20233A798) to Materion Precision Optics and Thin Film Coatings, Inc. (Materion) to authorize the distribution of filters containing thorium. Materion informed the NRC that the filters containing thorium were used by companies developing COVID-19 countermeasures. NMSS staff performed an expedited review of the application. The end users of the products distributed under the Materion exempt distribution license are exempt from any regulatory requirements. The staff determined that the expedited review of the license application maintained adequate protection of public health and OCTOBER 5, 2020 ENCLOSURE D

safety and the environment, did not endanger life or property or the common defense and security, and is in the public interest.

NMSS Staff Hold Public Meeting During Nuclear Code Week On August 21, 2020, the staff held a public WebEx and teleconference meeting to discuss the status of the Incorporation by Reference of American Society of Mechanical Engineers (ASME)

Codes into the NRC regulations as part of ASME Code Week. Approximately 130 people attended the public meeting and stakeholders provided feedback on a number of issues, including the proposed new condition regarding the treatment of operational leakage, the proposed change to the conditions on in-service testing and inspection standards for operating plants. The staffs presentation is available in ADAMS at ML20230A012.

NMSS Staff Hold Public Meetings on Environmental Impact Statement On August 25 and 26, 2020, the staff held public meetings via webinar and teleconference on the draft environmental impact statement for the Holtec International proposed consolidated interim storage facility in Lea County, New Mexico. The public meetings lasted around 3 hours3.472222e-5 days <br />8.333333e-4 hours <br />4.960317e-6 weeks <br />1.1415e-6 months <br /> and approximately 75-100 individuals participating in each. Twenty-two people providing verbal comments and the meeting on August 25, and 15 provided comments at the meeting on August

26. The final public meeting via webinar and teleconference will be on September 2, 2020. The comment period ends September 22, 2020.

NMSS Staff Hold Public Meeting on Potential Generic Environmental Impact Statement On August 27, 2020, the staff conducted the last two of a total of four public scoping meetings (afternoon and evening webinars) to receive comments and suggestions from the public on the review and potential update of the Generic Environmental Impact Statement for License Renewal (LR GEIS) of Nuclear Plants (NUREG-1437) and associated rule (Table B-1 in Appendix B to Subpart A of 10 CFR Part 51). Approximately 20 people attended the two sessions including representatives from nuclear industry and Federal agencies. The staff received no comments from participants during the scoping meetings. The scoping comment period closes November 2, 2020, and the staff will use information collected during the scoping process to determine whether to recommend updating the LR GEIS and 10 CFR Part 51. If updates to the LR GEIS and 10 CFR Part 51 are recommended, the staff plans to develop a rulemaking plan and submit it to the Commission for review and approval with a requested decision date by January 2021.

NMSS Staff Issue Guidance for Transportation Package Reviews On August 28, 2020, the staff issued NUREG-2216, Standard Review Plan for Transportation Packages for Spent Fuel and Radioactive Material as a final report. This Standard Review Plan provides guidance to NRC staff for reviewing an application for package approval issued under 10 CFR Part 71. NUREG-2216 is an update and consolidation of older guidance documents.

During the public comment period, the NRC received comments that were addressed in this revision. NUREG-2216 is publicly available in ADAMS at ML20234A651 and is available on the NRC website.

Technical and Rulemaking Support for Fitness for Duty Programs On August 24, 2020, contract number GS00F010CA/31310020F0094 was awarded to ICF Incorporated, LLC in Fairfax, VA. The purpose of this contract is to provide support services for the NRCs fitness for duty program. The period of performance is from August 24, 2020, to August 23, 2023, with two option periods. The total potential value of the contract can be up to

$872,182.00.

Data Architecture and Strategy Support On August 20, 2020, contract number TIRNO-99-D-00005/31310020F0095 was awarded to The Mitre Corporation in McLean, VA. The purpose of this contract is to provide the NRC with programmatic, functional, and technical expertise, including research, analyses, and recommendations to support the agency in developing its data architecture and strategy. The period of performance is from August 24, 2020, to August 23, 2021. The total potential value of the contract can be up to $649,707.00.
