Volume 85, Federal Register, Page 14736 (85FR14736), "Approval of American Society of Mechanical Engineers' Code Cases," dated March 16, 2020 In Reference 1, Exelon Generation Company, LLC (EGC) requested NRC approval of a relief request for Clinton Power Station (CPS), Unit 1. The proposed relief request would allow use of American Society of Mechanical Engineers (ASME) Code Case OMN-13, "Performance-Based Requirements for Extending Snubber Inservice Visual Examination Interval at LWR Power Plants," Revision 2, during the fourth interval of the CPS Inservice Test program. The fourth interval of the CPS Inservice Test program complies with the ASME Code for Operation and Maintenance of Nuclear Power Plants (i.e., OM Code), 2012 Edition. Although this Code Case has been unconditionally approved for use in Regulatory Guide (RG) 1.192, "Operation and Maintenance Code Case Acceptability, ASME OM Code," Revision 2, relief was requested because the Applicability section of the Code Case states that it is applicable to the ASME OM Code 1995 Edition through 2011 Addenda (i.e., which does not include the 2012 Edition that is applicable to the CPS Inservice Test program).

In Reference 2, a final rule was published in the Federal Register that, in part, incorporated by reference Revision 3 of RG 1.192. As stated in the Federal Register, the NRC has moved Code Case OMN-13, Revision 2, to Table 2 in RG 1.192 to clarify its acceptance for use with all editions and addenda of the OM Code listed in 10 CFR 50.55a(a)(1)(iv). Based on this final rule, which becomes effective on April 15, 2020, the relief requested in Reference 1 is no longer needed. Therefore, EGC is withdrawing the proposed relief request.
