Ladies and Gentlemen:

In a letter dated December 15, 2021 (i.e., Reference 1) Duke Energy Progress, LLC (Duke Energy), requested a one-time exemption for the Brunswick Steam Electric Plant (BSEP),

Unit Nos. 1 and 2, from the requirements of 10 CFR 50, Appendix E, Section IV.F.2.d.

Specifically, Duke Energy requested a one-time schedular exemption from the requirement for the State of North Carolina to participate in the ingestion pathway portion of an exercise at least once every exercise cycle. In a letter dated July 28, 2020 (i.e., Reference 2), the Federal Emergency Management Agency (FEMA), in consultation with the Nuclear Regulatory Commission (NRC), Region II, approved a request from the State of North Carolina to postpone the ingestion pathway portion of the December 1, 2020, BSEP Emergency Plan Exercise to July 26-27, 2022.

The purpose of this letter is to withdraw the requested one-time exemption (i.e., Reference 1) .

In a letter dated January 24, 2022 (i.e., Reference 3), the NRC informed Duke Energy that an exemption from 10 CFR 50, Appendix E, Section IV.F.2.d is not required.
