BRUNSWICK STEAM ELECTRIC PLANT, UNITS 1 AND 2 - WITHDRAWAL OF EXEMPTION REQUEST FROM THE REQUIREMENTS OF 10 CFR PART 50, APPENDIX E, SECTION IV.F.2.d (EPID L-2021-LLE-0055 [COVID-19])
Dear Mr. Krakuszeski:
By letter dated December 15, 2021 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML21349A926), Duke Energy Progress, LLC (the licensee) submitted to the U.S. Nuclear Regulatory Commission (NRC) a request for a temporary exemption from specific requirements of Appendix E to Title 10 of the Code of Federal Regulations (10 CFR)
Part 50,Section IV.F.2.d, for the Brunswick Steam Electric Plant, Units 1 and 2 (Brunswick).
Specifically, the licensee requested a one-time schedular exemption from the requirement in Section IV.F.2.d that the State fully participate in an ingestion pathway portion of the licensees emergency preparedness exercise at least once every exercise cycle due to the Coronavirus Disease 2019 (COVID-19) public health emergency (PHE).
On January 24, 2022 (ADAMS Accession No. ML21354A503), the NRC issued a letter to the licensee explaining that Section IV.F.2.d of 10 CFR Part 50, Appendix E, in using the word should, provides a best practice for ingestion pathway emergency preparedness exercises but does not create a regulatory requirement for the licensee. Therefore, no exemption from the NRC was required.
Subsequently, by letter dated January 31, 2022 (ADAMS Accession No. ML22032A111), the licensee withdrew the exemption request.
The purpose of this letter is to advise that the above-cited request is being treated as withdrawn.
