Units 1 & 2 Notification of Unusual Event Docket Nos. 50433p- Alert 50-330 Site Area Emergency Midland, MI 48640 General Emergency xxx Not Applicable Subjset: STOP WORK ORDER ON REMEDIAL SOILS WORK The licensee issued a stop work order for ongoing remedial safety-related soils work at the Midland construction site on August 9, 1982. The order was issued after Region III personnel datermined some work had been done that had not been approved by the Office of Nuclear Reactor R2gulation in advance as required by the order of the presiding Atomic Safety and Licensing Board.

A Confirmatory Action Letter was issued by Region III on August 12, and the Licensing Board will be notified by staff attorneys of the matter during a Prehearing Conference August 12 in Midland.

Region III and NRR representatives met with Consumers Power officials in Midland on August 11.

The NRR Licensing Project Manager reported that approvat had not been specifically given for the work in question -- excavation under safety-related piping -- but the licensee contended that approval had been given in that the work had been discussed with NRR personnel. Region III' plans to investigate the matter further.

Procedures will be developed by NRR, Region III, and the licensee for all future requests and approvals will be in writing for remedial soils work covered by the Licensing Board's order. Written approvals should avoid future disagreements on authorized work.

Region III does not plan to issue a news announcement. Local news media interest is expected, because the stop work order and the disagreement over work authorization is being presented at the Prehearing Conference.

l l This Preliminary Notification is being issued at this time because of possible news media interest resulting from the Prehearing Conference.

l The State of Michigan will be notified.

Region III was notified on August 9 by the licensee that work was being stopped after the authorization issue had been raised. Additional details became available during the August 11 i meeting. This information is current as of 10:30 a.m., August 12, 1982.
