Comments on Proposed Changes to 10CFR Part 71 The Westinghouse Electric Corporation wishes to offer the following comments on the proposed changes to Part 71 of the Commission ' s regulations. The proposed rule making was published on November 20, 1971, in the Federal Register, starting on page 22184.

We agree most heartily with the concept of concentrating the approvals of packages used for the transport of radioactive materials in the USAEC . Furthermore, we suggest that this situation be implemented with maximum efficiency by revising the wording of paragraph (b) of redesignated 71.10, "General Licenses, etc., to read : "(b) In a package whose use for such purpose has been approved by the Commission, provided that:"

We urge that by the addition of a new subparagraph (b) (3), or a note, it be explicitly stated that "approved by the Commission" means approved as a license amendment, a non-AEC licensee approval, a recommendation that the DOT revalidate a package of foreign origin, or an approval issued by an AEC field office to an AEC license-exempt contractor in accordance with the provisions of the AEC manual (Chapter 0529).

Each of the four types of approvals enumerated above should be the result of a consistent evaluation carried out by Commission personnel using Commission criteria. It seems thoroughly unnecessary to require an AEC licensee to fulfill all the detailed requirements of a formal submittal merely to go on record to obtain an authorization of previously evaluated A~knowledged by card _!_J_'>:iJ,1,~

t package. This extension of the general lice nse would reduce the regulatory work load and permit the AEC staff to concentrate on "new" applications. At the same time the existing restrictions would assure that the packages were properly utilized, so that the extended usage would not represent any increased hazard to the health and safety of the public.

We also suggest that proposed paragraph 71.l(a) be revised to read, " **. guantities of radioactive materials in excess **. ",

rather than stating "licensed materials". This change is based on the DOT's stated intent of requiring that the packages used for the transport of radium and other radio-active materials not normally subject to AEC regulations be reviewed and approved by the AEC in accordance with this Part.

We have reviewed the proposed amendment of 10 CFR 71 concerning transfer of the administrative requirement for approval of radioactive materials packages from the U.S. Department of Transportation (DOT) to the AEC which was published for comment in the Federal Register on November 20, 1971 (36 FR 22184) and submit the following com-ments for the Commission's consideration:

1. We agree with the proposal and wish to commend the DOT and the Commission for their cooperation in efforts to reduce administrative paperwork for radioactive materials package approval.
2. We note that a recent proposal (36 FR 22073) by the DOT would reduce the quantity of californium 252 in special form which can be shipped in Type A packages from 20 to 2 curies. We trust such reduction, if adopted, will be suitably reflected in the Commission's regulations.

We appreciate the opportunity to review the proposed amendment and look forward with pleasure to its rapid promulgation.
