FRAMATOME INC. - REQUEST TO AMEND LICENSE AND APPROVAL OF CRITICALITY SAFETY METHODS (ENTERPRISE PROJECT IDENTIFICATION NUMBER L-2023-LLA-0073)

Dear Timothy Tate:

The U.S. Nuclear Regulatory Commission (NRC) staff received your submittal dated May 17, 2023 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML23137A396; non-public), requesting to amend License No. SNM-1227 and to approve the extension of Framatomes methodology for determining the minimum margin of sub-criticality to include enrichments up to 20 weight percent Uranium-235.

We have completed our acceptance review of your submittal and have identified no administrative omissions or deficiencies that would prevent us from proceeding with a detailed review. Your submittal has been assigned Enterprise Project Identification Number (EPID)

L-2023-LLA-0073. Please reference this EPID number in any future correspondence associated with this request.

Accordingly, the NRC staff has established a schedule for this review, which includes the issuance of requests for additional information (RAIs), by June 25, 2023. The NRC staff anticipates completing its review and developing a safety evaluation report to address the submittal by the end of December 2023. This date could change depending on the findings of our technical review, urgent assignments, or other factors. We will promptly communicate any significant changes to this schedule. In addition, the NRC staff estimates that completing the review and making an independent assessment of the proposed application will require approximately 200 staff hours which corresponds to about $60,000 ($300/hour)1. We will promptly communicate any significant changes to this estimate.

In accordance with Title 10 of the Code of Federal Regulations, Section 2.390, Public inspections, exemptions, requests for withholding, of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of the NRCs ADAMS. ADAMS is accessible from the NRC website at http://www.nrc.gov/reading-rm/adams.html (the Public Electronic Reading Room).
