INDIAN POINT NUCLEAR GENERATING UNIT NOS. 1 AND 2 - REQUEST FOR ADDITIONAL INFORMATION REGARDING HOLTEC DECOMMISSIONING INTERNATIONAL, LLCS SUBMITTAL TO AMEND AND RESTATE THE INDIAN POINT UNIT 2, LLC MASTER DECOMMISSIONING TRUST AGREEMENT (EPID L2022LLA0072)

By letter dated August 10, 2022 (Agencywide Documents Access and Management System (ADAMS) Accession Nos. ML22222A087), Holtec Decommissioning International, LLC (HDI) provided notification to the U.S. Nuclear Regulatory Commission (NRC) of its Amended and Restated Holtec Indian Point 2, LLC Master Decommissioning Trust Agreement for Indian Point Nuclear Generating Unit Nos. 1 and 2 (Proposed Amended IP2 Master Trust Agreement) in accordance with Title 10 of the Code of Federal Regulations (10 CFR) 50.75(h)(1)(iii).
The NRC staff reviewed the Proposed Amended IP2 Master Trust Agreement and objected by email dated September 22, 2022 (ML22269A345). Based on its review of the Proposed Amended IP2 Master Trust Agreement, the NRC staff needs additional information to determine whether it complies with the applicable regulations. To complete its review, the staff has enclosed a request for additional information (RAI). The RAI specifically focuses on Section 3.07 of the Proposed Amended IP2 Master Trust Agreement, which does not appear to be consistent with 10 CFR 50.75(h)(1)(ii).
As discussed during a teleconference with HDI on October 13, 2022, HDI should provide a response to the RAI, or a written request for additional time to respond, including the proposed response date and a brief description of the reason for the extension request, by 30 days from the date of this letter.
Pending the acceptability and timing of the response to the RAI, the NRC staff anticipates completing its review of the Proposed Amended IP2 Master Trust Agreement. The completion review could be delayed depending on the findings of the staffs technical review, urgent assignments, or other factors. The NRC staff will promptly communicate any significant delay in the staffs review to HDI.
The response to the RAI must be submitted in accordance with 10 CFR 50.4, Written communications, and, pursuant to 10 CFR 50.30(b), Oath or affirmation, be executed in a October 21, 2022

Information included in the response that is considered sensitive or proprietary, and sought to be withheld from public disclosure, must be marked in accordance with 10 CFR 2.390, Public inspections, exemptions, requests for withholding.
