OF MARCH 15, 2022, MEETING WITH GESELLSCHAFT FÜR NUKLEAR-SERVICE MHB TO DISCUSS THE APPLICATION AND REQUESTS FOR SUPPLEMENTAL INFORMATION FOR THE CERTIFICATE OF COMPLIANCE FOR THE MODEL NO. CASTOR GEO69 STORAGE SYSTEM (DOCKET NO. 72-1052)

Background

On March 15, 2022, a public meeting was held virtually, at the request of Gesellschaft Für Nuklear-Service mHb (GNS-mHb) with the U.S. Nuclear Regulatory Commission (NRC) staff (Agencywide Documents Access and Management System (ADAMS) Accession No. ML22046A030). The meeting was noticed in the NRCs public website (ADAMS Accession No. ML22061A156) as an Observation meeting with a portion closed to the public due to proprietary content. The notice included the agenda for the meeting. Enclosure 1 includes the list of participants. Enclosure 2 includes the presentation slides discussed in the portion of the meeting open to the public (ADAMS Accession No. ML22046A028).

Discussion The purpose of the meeting was to discuss details related to the request to NRC from GNS-mHb for certifying the Model No. CASTOR geo69 storage system and the requests for supplemental information (RSIs) submitted by the staff. The applicant submitted this request by letter dated May 3, 2021 (ADAMS Accession No. ML21126A156). The Model No. CASTOR geo69 is a new storage system for transporting spent fuel assemblies. The following section includes a summary of the discussion during the public potion of the March 15th meeting.

Y. Díaz Sanabria Summary Besides applying for the Model No. CASTOR geo69 storage system, the applicant also applied for the approval of a package design for the Model No. CASTOR geo69. The applicant mentioned that they had submitted a quality assurance plan for NRCs approval under Docket No. 71-0967.

The applicant proceeded to briefly discuss and explain their approach for submitting the storage and transportation applications. The applicant explained that the transportation and storage designs are usually submitted together in Germany for review. Currently, the storage application references information of the application for the packages design. The applicant further explained the following about status in Germany regarding storage facilities and systems:

1) 12 on site storage facilities at nuclear power plants;
2) 2 central intermediate storage facilities;
3) no standalone certificates for dry storage systems;
4) dry storage systems are included in the license for storage facilities;
5) Separate regulatory authorities; and
6) no general applicable requirements (like general licensees in the U.S.).

As previously explained to the applicant, the staff commented that given the current regulatory infrastructure in the U.S. storage and transportation applications are submitted separately. One of the reasons is the criteria in 10 CFR 72.48 for screening changes that require an amendment to the certificate of compliance for a storage system or changes that can be made without previous NRCs approval. Since this topic has been previously discussed with the staff, the applicant mentioned that they already decided to split the storage and transportation as standalone applications. The staff asked if there are regulations like 10 CFR 72.48 in Germany.

The applicant replied that there is no comparable process in Germany. Therefore, the 10 CFR 72.48 criteria and process is new for the applicant. The applicant explained that the German competent authority participates on the manufacturing of each cask.

The applicant also explained that they defined a generic environment as well as boundary conditions for the design of the storage system. The applicant mentioned that they use the following guidance to develop the application:

1) Regulatory Guide 3.61
2) NUREG-2215 and applicable reference documents (with exception of chapters only applicable to specific licenses).
