to the utility for investigation?

ANSWER As noted ir the answer to Question (1)(a), the NRC received information on January 7,1987, that the plant manager may have been in the control room on l

December 31, 1906, shortly after drinking alcohol and ma.y have been a disrup-tion tc the control room activities. The NRC treated this information as an allegation and referred the matter to the licensee for investigation in a letter # rom the Pegional Administrator, James G. Keppler, to the President of Toledo Edison Company on January 29, 1987 (Document No. 1-6 of Enclosure (1)(d)-2).

This matter was referred to the licensee because it was judged initially not I

to involve a regulatory violation, but may have involved actions contrary to the licensee's fitness-for-duty policies, and because, at that time, an 01 l

investigation of the matter was not planned. This matter was handled in 1

accordance with NRC and Region III policies and procedu6s.

Furthermore,-NRC Manual Chapter 0517 (Draft - 9/19/84 (Enclosure (1)(b)-1)), Appendix 1, I

Part VI.1.i. and NRC Region III Procedure 0517A, (Enclosure'(1)(b)-4)

Appendix A, Part II, encourage the utilization of licensee resources to address allegations'sub,iect to the review and evaluation of the NRC if certain' conditions are met.

I Region 1:: Procedure 0518 (Enclosure (1)(b)-2), Part 3.a, indicates that investigation of matters involving the fitness for duty of licensee employees should be tne responsibility of licensee management (Enclosure (1)(b)-2).
