SUBJECT: CLOSE OUT OF 01 INQUIRY INTO MIRIELLO ALLEGATION

Recently, we had discussions concerning a violation appearing in Inspectibn'

Report 50-400/85-48. You may recall that this dealt with a Severity Level V

violation for. failure to follow procedures at Shearon Herris. The issue involved

was related to allegations by Ms. Miriello about Shearon Harris. I understand

that 01 is investigating or considering investigating this issue to determine

whether the violation was intentional. It was agreed during discussions between

you and Region II staff members that 'the safety significance of the subject

violation would not justify a high priority for your. investigation and that it

would be. some time until 01 could complete its investigation. Currently,

George-Jenkins has been advised by Jane Axelrad not to proceed with enforcement ,

action where an ongoing 01 investigation may eventually indicate an intentional / ,

violation has occurred. ,

As a result of the.above situation, we are currently holding up the issuance i

Report No. 50-400/85-48. However, recently the Commission has approved guidance

for establishing the priority of-investigations. (Copy' enclosed).- As we under--

stand pages 3 and 4 of that guidance, the pending investigation of this Miriello

issue could be terminated based on the fact that your investigation will not be

completed within a reasonable time (siy. months) because of resource restrictions. 4

We suggest that it may be appropriate to forward the Miriello allegation involved

in Report No. 50-400/85-48 to' the Director, 01, for a detennication of whether

termination is appropriate. Such a determination would free the Region to' issue s ; ,"

Report No. 50-400/85-48 and its associated enforcement action. <
