I am pleased to respond to your referral dated July 11, 1975 regarding Mrs. Jackie Swigart's letter of May 17, 1975.
I On April 30, 1975', Governor Carroll requested the Nuclear Regulatory Commission (NRC) to make an independent review of the current situation at the Maxey Flats, Kentucky, consnercial waste burini ground and to provide him with our findings. The NRC recently completed this review I'
and forwarded the report to Governor Carroll on July 14, 1975 (Enclosure 1).
The report generally concludes that there is no significant public health problem associated with the release of radioactive material from the burial site and that the Statp has been taking appropriate action concerning

implementation of recommendations contained in the State's six month study report of December 1974. The NRC review group did make several recommenda-tions for the State to consider. These dealt principally with. methods for l
improving water management at the site.
I With regard to the General Accounting Office survey of low level radioactive vastes, we understand this report has not yet been published.
In accordance with your request, Mrs. Swigart's letter is enclosed.
