Bethesda, MD Docket No. GDP-2 Subject PROPOSED IMPOSITION OF civil PENALTY - $55,000 This is to inform the Commission that a Notice of Violation and Proposed imposition of Civil Penalty (Notice) in the amount of $55,000 will be issued on or about March 19,1998, to United States Enrichment Corporation (USEC). The action is based on a Severity Level ll1 problem for 16 violations involving major deficiencies in the nuclear criticality safety and self-assessment programs at USEC's Portsmouth facility.

In accordance with the Enforcement Policy, a base civil penalty in the amount of $55,000 is considered for a Severity Levellil problem. Because the problem was categorized as a Severity Level 111, the staff considered whether credit was warranted for Corrective Action in accordance with the civil penalty assessment process in Section VI.B.2 of the Enforcement policy. Credit for USEC's corrective action is not warranted because significant NRC effort was necessary to focus USEC's corrective action processes in order to obtain comprehensive corrective actions.

Therefore, a civil penalty in the base amount of $55,000 is being proposed.

It should be noted that the licensee has not been specifically informed of the enforcement action.

The schedule of issuance and notification is:

Mailing of Notice March 19,1998 Telephone Notification of Licensee March 19,1998 The State of Ohio will be notified.

The certificatee has thirty days from the date of the Notice in which to respond. Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
