PROPOSED IMPOSITION OF CIVIL PENALTY - $55,000 This is to inform the Commission that a Notice of Violation and Proposed imposition of Civil Penalty in the amount of $55,000 will be issued on or about July 14,1998 to the United States Enrichment Corporation (USEC). This action is based on a Severity Level lli i

violation involving a programmatic deficiency in the maintenance and surveillance program for air-operated, safety-related valves at USEC's Portsmouth plant.

Because the Portsmouth plant has been the subject of escalated enforcement actions within the last two years, the staff considered whether credit was warranted for /dentification and i

Corrective Action in accordance with the civil penalty assessment process in Section VI.B.2 of the Enforcement Policy. Credit for identification is not warranted because staff identified the valve issue and brought it to USEC's attention. However, credit for conective action is warranted because USEC took prompt and comprehensive action to define the magnitude of the problem and to implement corrective actions.

It should be noted that the Certificatee has not been specifically informed of the enforcement action. The schedule ofissuance and notification is:

Mailing of Notice July 14,1998 Telephone Notification of Licensee July 14,1998 The State of Ohio will be notified.

The Certificate has thirty days from the date of the Notice in which to respond. Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by
