Notice of Violation and Proposed Imposition of Civil Penalty This refers to a special inspection conducted by the NRC during the period of December 30, 1985 through January 7, 1986 of activities authorized by NRC License No. DPR-82. A copy of the associated Inspection Report (No. 50-323/85-45) was sent to you by letter dated January 8, 1986. An Enforcement Conference also was

held at the Diablo Canyon site on January 10, 1986, with members of your staff.

Based on the results of this inspection and as discussed during the Enforcement Conference, it appears that one of your licensed activities was not conducted in full compliance with NRC requirements.

The violation described in the enclosed Notice of Violation and Propos'ed Imposition of Civil Penalty involved the inoperability of one channel of the automatic actuation logic of one main steam isolation valve (MSIV). The violation was caused by a wiring error in which the actuating coil of the MSIV solenoid valve was bypassed. Over a period of months, evaluations of events provided several opportunities to identify and correct the underlying problem yet you failed to do so. In determining the cause of this violation, additional defi.ciencies in your troubleshooting techniques and post-maintenance testing program were identified.

To emphasize the importance that the NRC attaches to the identification and correction of conditions adverse to quality and timely and proper resolution of plant problems, I have been authorized, after consultation with the Director,.0ffice of Inspection and Enforcement, to issue the enclosed Notice of Violation and Proposed Imposition of Civil Penalty in the amount of

Fifty Thousand Dollars ($50,000) for the violation described in the enclosed Notice. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1985) (Enforcement Policy), the violation described in the enclosed Notice has been categorized

! as a Severity Level III violation. The base civil penalty for a Severity Level III Violation, $50,000, has been proposed because the factors supporting mitigation of the penalty in this case appear to be offset by the duration of the violation and the numerous missed opportunities for timely identification and correction.

In accordance with Section 2.790 of the NRC's " Rules of Practice," Part 2, Title 10, Code of Federal Regulations, a copy of this letter and its enclosure will be placed in the NRC Public Document Room.

The responses directed by this letter and the enclosed Notice are not subject to the clearance procedures of the Office of Management and Budget as required by the Paperwork Reduction Act of 1980, PL 96-511.
