Dear Mr. Artigas:

This is in response to Mr. Sherwood's letter of November 5,1986, regarding l

a fee schedule program. The U.S. forNuclear the Advanced RegulatoryBoiling Water(Comission Comission Reactor (ABWR))supports the Certification j development and utilization of standardized designs and encourages the use of a reference system concept. The Commission is currently considering a proposed Standardization Policy Statement as well as a detailed NUREG document which discusses the issues and topics that are important to the execution of a standardization policy.

As part of the proposed implementation of the standardization policy, the Comission is considering revision of 10 CFR Part 170 to include a new provi-sion for approval and certification of standard designs. Under consideration are several proposals, including Mr. Sherwood's proposal, as to how approval costs would be recovered through the collection of fees. In any event, full recovery of the costs would be achieved from the holder of the design approval '

or certification (if recoverable) through referencing or at the end of the i recovery period.

Some of the proposed revisions to Part 170 are within current NRC authority g ;g and do not require further legislation. However, should the 100th Congress
