Mike: I talked to Pawlik about the referral to the IG that he

said that he would take care of during the allegation' review l board meeting. He said he has not done anything yet because he was waiting for. the paper work f rom Don Funk. I volunteered to develop a " straw man" however, he said it would not be necessary.

l So, to expedit e things, I provided Pawlik with our files on the

! Uniontown landfill and told him that I would be availabl.e to

! assist him if he-had any questions regarding this matter. I i

brief ed GLS and he said that we should check with Pawlik next week to check on the status of the referral.

Receipt of Hail from A11eger on April 12, 1994 AMS-No. RIII-94-A-0026, Possible Dumping of Radioactive Materials in Landfills (Uniontown,0H)

On April 12, 1994, I received copies of letters from the alleger to the U. S.

Department of Health and Human Services, Agency for Toxic Substances and Disease Registry (ATSDR) dated 4/7/94 which was in response to their letter dated 3/29/94. This letter implies displeasure with that agencies decision on certain matters that involve the Uniontown Landfill. Certain statements such as "How two-faced can you be" and "this failure is inexcusable for a health agency charged with protecting health" and the last page references a congressional investigation into the agencies work performed at Superfund si' is. I am not sure why the alleger sent this information to me, nor did I rauest this information; however, due to the sensitivity of this issue, I sent copies of this memo and the attachments to Gene Pawlik, Region III 01.

As a side issue, during a telephone conversation on April 6,1994 with the alleger, .she stated to Mike McCann and me that she did trust the U. S. EPA Inspector Generals office and felt that any investigation they do will be biased in favor of the EPA. She also implied that a staffer from one of the Ohio congressman office made the same statement. We relayed this information to Gene Pawlik and Bruce Berson; however, they did not feel this statement constituted a new allegation.

the report on 6/20/94 and you are cur,ren I informed her that we received what further actions the NRC will take. tly reviewing the rsport to determine She adamantly claims that the SAB' report is a " whitewash" by EPA and contains ' watered-down" conclusions. As an example the report did not mention the plutonium found in a 92' bore sample, they disregarded and minimized the significance of the high tritium concentrations in certain water samples and the high gross beta counts found in certain water samples collected by the State of Ohio.

She stated that we have a moral, legal and ethical obligation to immediately write a rebuttal to the SAB report and we should conduct our own independent analyses of the environmental. radiation levels including a complete field study at Uniontown.
