This is to advise you that the Commission has not objecteu to t your proposed issuance of the revision to 10 CFR 20.305 subject to the attached modifications. Accordingly the staff may proceed.

In addition, as noted in the Chairman's memorandum of July 27, 1988, the petition should be revisited after the Commission has approved a policy on below regulatory concern.

Regulatory Flexibility certification 1

In accordance with the Regulatory Flexibility Act of 1980 (5 U.S.C. 605(b))

the Cosnission certifies that this rule will riot, if promulgated, have a significant economic impact on a substantial number of small enti'.ies. This proposed rule affects only nuclear power plants. The companies that own these plants do not fall within the scope of the definition of "small entities" set forth in the Regulatory Flexibility Act or the Small Business Size Standards set out in regulations issuer by the Small fusiness Aaministration at 13 CFR Part 121.

Backfit Analysis This amendment to the Cosnission's regulations would not impose any new requirements on production or utilization facilities; it only allows incineration of waste oils onsite without the need for specific approval by license amendment. The amendment to 10 CFR 20.305 is therefore not a backfit under 10 CFR 50.109 and a backfit analysis is not required.
