SUBJECT:
PROPOSED REVISION TO 10 CFR 20.305, WASTE DISPOSAL BY INCINERATION As a response to a petition from the Edison Electric Institute, the Office of Nuclear Regulatory Research (RES) is proposing to amend 10 CFR 20.305 to allow the onsite incineration of slightly contaminated waste oils at nuclear power plants without the need for specific license amendments. This rule change would allow such incineration to be carried out only within already-established plant technical specifications which limit the release of radioactive material to the general environment. RES received approval from the Executive Director for Operations to proceed with this action with the near-term objective of publishing a proposed rule for public comment.
Because this proposed rule change does not impose mandatory requirements on Commission licensees and would neither diminish plant safety nor adversely impact on the quality of the environment, we believe that this rulemaking need not be formally reviewed by the CRGR or the ACRS. The draft rule package, which is currently undergoing division review, is attached.
