Dear Mr. Baucer:

This letter responds to the petition for rulemaking)(PRM-20-15), which you submitted to the Nuclear Regulatory Comission (NRC on behalf of Edisen Electric Institute and the Utility Nuclear Waste Management Group on July 31, 1984.

In the petition, you requested the NRC amend its regulations to define concentrations of radioactive material in reactor-generated waste oils which would permit disposal of these oi S without regard to their radioactive material content. The petition pruposed a broad exemption using a 1 mrem / year dose criterion with nuclide specific concentration limits for each of several disposal alternatives: on-or offsite incineration, on-or offsite burial, road stabilizatier (spraying), and recycling.

NRC published a not.'ce of receipt of the petition in the Federal Register on September 19,1984 (49 FR 36653) and requested public coments. Fourteen coments were received including your letter reacting to the other coments.

The NRC has considered the petition and the public coments submitted in response to it. As discussed in the enclosed Federal Register Notice, which will be published in the next few days, the Comission has found that the information supplied by the petition is insufficient to justify amending its regulations as proposed by the petition, However, the Comission is proposing I

to amend its regulations to provide one alternative to the disposal of reactor-generated waste oil at low-level waste burial grounds. The proposed rule, if adopted, would allow nuclear power licensets to incinerate, onsite, slightly contaminated waste oils without the need for a license amendment. The NRP hereby denies the other aspects of your petition withcut prejudice.
