Thank you for your June 18, 1968 letter asking for inforcution I ro;,arding regulations governing the ninitsua distance tetween a residence and a nuclear power plant. Our Division of Comp 11.snce of fice in bev York sent us your letter for reply.

The C<xamission's criteria governing the miniuum distance between nuclear power plants and residences are contained in Sections .

100.3(a) and 100.11(a)(1) of Title 10, Codo of rederal Pegulations.

1 Part 100. "heactor Site Criteria." You may note in Section 100.2(a) that Part 100 is applicable only to stationary power and testing reactors that must be licenseed. You may also note that tue Leparttent of Cefense is exempt from the requitecont for a license as explained in Sections 50.2(c) and 50.11(a) of Title 10, code of Federal Regulations, Fart 50, "1.icensing of Production and Utilisation Facilities." l If you need any further informattoo on this matter, let me know.
