INCENTIVE REGULATION OF NUCLEAR GENERATING FACILITIES BY

, STATE PUBLIC UTILITY COMMISSIONS (PUCS)

In SECY-85-260, subject as above, the staff informed the Comissioners of its effort to track nuclear power plant perfonnance incentives established by PUCs, develop a data base, evaluate possible safety effects, and provide periodic reports of its findings. The Office of State Programs is tracking the incentives and has prepared a plant-specific report on the methodology and potential financial costs of the incentives (Enclosure 1). This current report updates information in a report issued in January 1984 (Enclosure 2).

Performance incentives are shown to be now applicable to the construction or operation of 37 reactors in 15 States.

We are continuing to monitor developments at utilities and State PUCs to provide updated infonnation for subsequent reports. It is planned that the report will be updated and distributed semiannually. Your coments on the enclosed report and suggestions for future reports are requested.
