i RESPONSE OF THE STATE OF NEW YORK TO THE NRC STAFF'S FIRST SET OF INTERROGATORIES AND REQUESTS FOR PRODUCTION

.0F DOCUMENTS REGARDING HOSPITAL EVACUATION TIME ESTIMATES This is the State of New York's response to the NRC Staff's First Set of Interrogatories and Requests to Produce to Suffolk County, State of New York and Town of Southampton Concering Hospital Evacuation," dated February 29, 1988 ("NRC Staff's First Set of Interrogatories and Requests").1 To the extent that the NRC Staff's First Set of Interrogatories and Requests seeks information and documents of any sort that are not within the possession, custody or control of the State of New York, but, rather within the possession, custody or control of 1The Board's "Memorandum and Order (Ruling on LILCO's Motion for Summary Disposition of the Hospital Evacuation Issue),"

dated February 24, 1988 and received by the State of New York on March 1, 1988, established a discovery period commencing upon receipt of the Order.

This response is being served within the time frames established in 10 CFR 2.740b, 2.710 and the Order.

L counties, towns or other local governments (including suffolk County the Town of Southampton), the State of New York objects.

Counties, towns or other local governments are autonomous from the State of New York and are not within the State of New York's control.

Accordingly, the burden of obtaining such information is the same for the NRC Staff as it is for the State of New York.

To the extent that the NRC's First Set of Interrogatories and Requests seeks information and documents of any sort that are protected against disclosure, for example, by attorney work product doctrine, the State of New York objects.

NRC Staff Interrocatories Nos. 1-2 1.

With regard to hospital evacuation time estimates, identify the person [s] whom Intervenors expect to call as a witness.

For each witness:

a.

State the substance of his or her testimony, including the facts and opinions to which the witness is expected to testify; b.

Provide the basis for each such opinion; c.

Identify and provide all documents, including upon which the witnesses intend to rely; d.

Identify all prior statements made by the witnesses in testimony or deposition, in this or other proceedings, which concern the subject matter of their testimony.

Response

In response to paragraphs 1(a) snd 1(b), on March 9, 1988, the State of New York identified David T.

Hartgen, Ph.D.,

as an expert witness it expects to call to testify on hospital evacuation time estimates.

Dr. Hartgen will likely offer

1 testimony concerning the bascs and accuracy of LILCO's hospital 2

O evacuation time estimates.

Although Dr. Hartgen's review of the calculations underlying the time estimates has not been completed yet, Dr. Hartgen's testimony will probably concern questionable methodological assumptions and procedures regarding travel speeds, reception hospital assignments and capacities, vehicle allocations, route designations and other assumptions and procedures.

It is possible that further discovery, investigation and analysis could have an effect on the substance of Dr.

Hartgen's testimony.

In response to paragraph 1(c), at this time, the State of New York has identified several such documents, they are attached hereto.

If any such documents are identified as a result of further discovery, investigation and analysis, they will be provided as appropriate.

In response ta paragraph 1(d), as the NRC Staff is aware, Dr.

Hartgen testified in the 1984 emergency planning hearings and 1987 reception center hearings concerning Shoreham evacuation time estimates.

Dr. Hartgen's prefiled testimony was provided to the NRC Staff when it was filed in those proceedings.

Other than that profiled testimony and Dr. Hartgen's February 1, 1988 affidavit submitted in this hospital evacuation cime estimate proceeding, the State of New York is not aware of any such statements.

For each witness identified in response to Interrogatory 1, provide a statement of the witness' educational and professional background, with specific reference to his or her qualifications to give the particular testimony.
