NRC STAFF MITIGATES PROPOSED FINE AGAINST FLORIDA POWER & LIGHT The Nuclear Regulatory Connission staff has mitigated a $40,000 civil penalty proposed on February 2 of this year for violation of NRC radiation protection requirements at Florida Power and Light Company's (FP&L) Turkey Point nuclear plant near Homestead, Florida.
NRC initiated the enforcement action because of an incident in October 1983 when two workers entered a locked, high radiation area of Turkey Point Unit 3 without obtaining a required radiation work permit.
Both workers received radiation exposures, but not in excess of NRC limits.
Richard C. DeYoung, Director of the NRC Office of Inspection and Enforcement, inforned FP&L in a letter that the fine is being fully mitigated following an analysis of the company's response to the proposed action, two enforcement conferences with FP&L officials, and several co-site reviews. He said NRC's review has confirmed that the violation did occur and that its severity was correctly assessed originally by the staff. itr. DeYoung added NRC remains concerned that adeauate management controls be maintained and that
" continued steady progress" be made in radiation protection.
He said, however, that he is exercising his discretion to mitigate the civil penalty because the company reported the incident immediately, promptly investigated the circumstances, tcok extensive corrective action and implemented other long-range actions to improve the health physics program at Turkey Point.
