NRC STAFF CITES KANSAS GAS & ELECTRIC COMPANY PROPOSES $64,000 FINE The Nuclear Regulatory Commission staff has cited the Kansas Gas &
Electric Company (KG&E) of Wichita, Kansas, for an apparent violation of NRC regulations and proposes to fine them $64,000.
The infraction involves the Wolf Creek Generating Station, a nuclear project nearing completion, near Burlington, Kansas.
The NRC citation was issued as a result of an investigation and hearing conducted by the Department of Labor (D0L) into a discrimination complaint filed by James E. Wells, Jr., in August 1983. Mr. Wells claimed he was disciplined, discharged, and refused reemployment because he told KG&E's quality assurance manager about various safety problems relating to electric hardware and electrical installations at the Wolf Creek facility.
In June 1984, the Secretary of Labor affirmed an earlier decision of a D0L Administrative Law Judge that a violation of the employee protection provision of the Energy Reorganization Act of 1974 had occurred.
Consequently, after reviewing the D0L record, the NRC found'that KG&E was in apparent violation of the Commission's regulations. John T. Collins, Region IV Administrator, today stated in a letter to KG&E that " discrimination by a Commission license against an employee for engaging in certain protected activities is prohibited. The activities protected include reporting of quality discrepancies and safety problems by an employee to his employer."
KG&E is required to respond in writing to the violation within 30 days.
