SUBJECT:
PROPOSED RULE ENTITLED, " LOW-LEVEL WASTE SHIPMENT MANIFEST INFORMATION AND REPORTING" Endosed for review by the Committee to Review Generic Requirements (CRGR) are 15 copics of the subject proposed rule. Included is the Commission Paper which indudes, among other things, the Federal Register notice and the Draft Regulatory Analysis.
The proposed rule would amend 10 CFR Parts 20 and 61 to (1) improve the quality and uniformity of information contained in manifests accompanying shipments of low-level waste (LLW); (2) establish minimum requirements for storage and manipulation of shipment manifest information in computer recordkeeping systems at LLW disposal facilities; and (3) require that disposal facility operators routinely submit, in an electronic fomtat, reports of manifest infonnation. The proposed amendments would improve the NRC and State programs for regulation of LLW disposal, and would remove roadblocks in the development of a national computer data base containing complete waste information from all LLW disposal facilities. The proposed amendments would also amend our regulations to be consistent with the requirements of the Low-Level Radioactive Waste Policy Amendments Act of 1985.
This rule does not involve provisions of the backfit rule, as defined in 10 CFR Part i 50.109, and no backfit analysis has therefore been prepared. The additional information to be submitted on shipment manifests will not require reactor operators to make any changes in operational procedures. The additional information is already known by the licensees and needs merely to be reported.
The additional information is:
- 1. A better physical description of the waste container;
- 2. The manufacturer and model of any high integrity containers used;
- 3. An improved physical and chemical description of the waste;

- 4. The identity of the solidification vendor (solidification agent is already i required);

- 5. The identity of the most prevalent chelating agent within the waste (total weight of all chelating agents is already mquired); and j
- 6. _ An identification of hazardous waste materials pursuant to EPA regulations.

I Licensee's software packages can be easily modified to re)x>rt this additional ,
information on shipment manifests. Vendor software packages are routinely upgraded to incorporate changing requirements by the Department of Trans- !
portation, States, or disposal operators. Vendor softwam packages usually in- ;
dude maintenance and update services, and no additional costs would be ,
involved. For those licensees who have developed their own software to generate l shipment manifests, we estimate that it would cost between $2,000 and $5,000 for this one time upgrade. :
The proposed rule has received concurrence from the Offices of Nudear Material Safety and Safeguards, Administration, and Governmental and Public Affairs. The Office of General Counsel has reviewed the package and this memorandum and has no legal objection.
