1 ACTION: Final Rule: Correction.

SUMMARY

This document corrects a notice appearing in the Federal Register on Monday, March 27, 1995 (60 FR 15649). The action is necessary to correct an error of omission. The text of paragraph III E to Appendix G to Part 20 was inadvertently omitted from the codified text of the final rule. The wording for this paragraph is identical to the existing corresponding paragraph III E to Appendix F to Part 20. The text paragraph was not changed in the proposed rule and should have been repeated verbatim as part of the new Appendix G that was added in the final rule. ,

EFFECTIVE DATE: This correction has the same effective date as the final rule of March 1, 1998. ,

  • i E. Any shipment or part of a shipment for which acknowledgement is not received within the times set forth in this section must:
1. Be investigated by the shipper'if the shipper has not received i i

notification or receipt within 20 days after transfer; and

. 2. Se traced and reported. The investigation shall include tracing the  !

shipment and filing a report with the nearest Commission Regional Office ,

listed in Appendix 0 to this part. Each licensee who conducts a trace

lnvestigation shall file a written report with the appropriate NRC Regional ,

Office within 2 weeks of completion of the investigation.

Dear Ivan Selin:

Participants in the Low-Level Radioactive Waste (LLW) Forum have )

advocated and been involved in the development of a uniform manifest l rulemaking from the inception of the draft rule to the present. At its April ,

meeting, the Forum as a whole again endorsed the Nuclear Regulatory l Commission's efforts to establish a low-level radioactive waste manifest system. The text of the Forum's motion, which included general comments on the proposed rulemaking, was included in my letter to you of June 3,1992.

A copy of this letter was also submitted to the docket on the proposed rulemaking. Since the April meeting, a number of individual states and compacts have submitted more specific comments on the proposed rule.

At its July meeting, Forum Participants again discussed the proposed uniform ,

I manifest rulemaking. During this discussion, presentations were made by the Forum's Manifest Tracking Working Group and by an NRC staff person.

In light of informal discussions between members of the Manifest Tracking Working Group and some affected parties in the private sector, the working group concluded that a meeting allowing affected parties to work together and to discuss their views on the proposed rule would be an efficient way to ,

resolve differences among various affected groups and move to a more effective rule. Such a meeting would also fulfill the important educational i need of clarifying the intent, purpose, and mechanics of the proposed rule- '

a need that the working group strongly feels should be met.

Following the discussion, Forum Participants unanimously passed the  !

following resolution. l Resolved, that the LLW Forum should communicate with the  !

- Nuclear Regulatory Commission and suggest that NRC sponsor ,

an interactive meeting involving the Forum, the Nuclear Waste Brokers and Processors Association, and representatives of other  ;

appropriate parties that may have commented on the proposed  ;

uniform manifest rulemaking. i Forum Participants also again expressed their appreciation of NRC's efforts to [

develop a uniform manifest. l As you know, the LLW Forum is an association of representatives of states and compacts established to facilitate implementation of the Low-Level Radioactive Waste Policy Amendments Act of 1985 and to promote the  ;

objectives of low-level radioactive waste regional compacts. The Forum provides an opportunity for states and compacts to share information with one another and to exchange views with officials of federal agencies. LLW l Forum Participants- officials appointed by Governors and Compact Commissions-include representatives from regional compacts, designated  !

host states, unaffiliated states, and states with currently operating low-level l radioactive waste disposal facilities. Afton Associates,Inc., is the i management firm for the Forum. i l
