PARTIAL DISAPPROVAL OF OMB CLEARANCE FOR PROPOSED RULE, 10 CFR 20 AND 61, LOW LEVEL l

WASTE SHIPMENT MANIFEST INFORMATION AND REPORTING On May 8, 1992, NRC submitted a request for OMB review of the information collections contained in the proposed rule, 10 CFR Parts 20 and 61, Low Level Waste Shipment Manifest Information l

and Reporting, and the following three newly developed " Uniform Low Level Waste Manifest" forms and continuation pages:

" Shipping Paper" (NRC Forn 540 and 540A), " Container and Waste l

Description" (NRC 541 and 541A), and "Index and Regional Compact

-Tabulation" (NRC Form 542 and 542A).

By notice dated July 7, 1992, OMB approved the information l

collections contained in the revision to 10 CFR Part 20, as requested, approved all the forms with conditions, and disapproved all the information collections contained in the revision to 10 CFR Part 61, although they only had concerns with the requirement at 61.80(1) that land facility operators report electronically the stored manifest records.

OMB believes that i

because the facility n.aintains these records, and NRC can audit them, it is unnecessary for the facility to report the information to NRC.

Because OMB has filed comments with the agency on this collection, NRC must resubmit the 10 CFR Part 61 information collections to OMB no later than the date the final rule is published in the Federal Reaister, and provide a response to the OMB comments.

OMB has 60 days to review the information collections before approving or disapproving them.

At that time, OMB may disapprove the collections if it believes that NRC's response to its comments is unreasonable, and the collection of information is unnecessary for the proper l

performance of the agency's functions (5 CFR 1320.13 (g) (3) ).

In addition, i' NRC substantially modifies the information collections contained in the final rule in response to OMB's or commenters' concerns, NRC must submit the revised information collection package to OMB no later than 60 days before the final rule is published in the Federal Reaister (5 CFR 1320.13 (g) (2)).

on each associated " Notice of Office of Management and Budget Action," it states that an information collection request for each form must be resubmitted to OMB at the final rule stage for approval of the full burden the forms would impose.

At that time, OMB will also consider any public comments received in making its decision to approve or disapprove the burden imposed by the forms.

Please include and explain in the resubmittal the disposition of any comments received from industry that address the burden that these forms would impose.

You may also wish to stress in the resubmittal that industry currently completes nonstandardized forms, and that the use of standardized forms could potentially reduce the licensee burden imposed by this information collection.
