Review of the LILCO Plan for Shoreham, Revision II In the memorandum dated November 10, 1983, from Edward L. Jordon, Director of the Emergency Preparedness and Engineering Response Division of the Nuclear Regulatory Commission (NRC), the NRC granted the Federal Emergency Management Agency an extension of 60 days (i.e., until February 1, 1984) for transmission of findings based on the Regional Assistance Committee (RAC) review of the LILCO Transition Plan, including Revision II.
In order to meet the February 1, 1984 deadline, the review of LILCO's revision II must be accomplished under the following schedule:
Activity Target Date o RAC comments to FEMA January 10, 1984 (provide comments on the attached form) e FEMA comments review and January 19, 1984 consolidation (Revisions 1 and 2) e RAC meeting to review January 20, 1984 consolidated comments FEMA Regional Office forward 5 January 26, 1984 e
plan conunents (Revisions 1 and 2) to FEMA Headquarters While reviewing Revision II, please ensure that all NUREG-0654 elements that your agency is responsible for are addressed (see attached guidence).
2-I fully understand what affect this tight deadline has on your workload and with other agency commitments, but once again I must ask for your commients to meet this critical deadline.

have just received a copy of your very relevant letter of November I
16, 1983 to Guy Cunningham re:
the " derelict" action of the NRC in its granting of a low-power operating license to LILCO under the unique circumstances that now prevail.
While the NRC's action in this instance may appear to be technically legal to NRC Executive Legal Director Cunningham, it sera of dubious rational value in light of the particular circumstancs circumscribing Shoreham.
Without full attention to the circumstances, the assumed perogative for granting or rejecting the low-power license by NRC can hardly be said to exist.
That perogative, in actuality, can only be said to exist when a full. examination and response is made to the relevant evidence that pertains, otherwise we would grant power to madmen and idiots without compunction.
To say it another way, Mr. Cunningham's attempts to legalize the NRC's decision fails the test of reasonableness because of the lack of a
. knowledgeable response to existing and pertinent evidence.
as you so properly disclose, John, is not the right of NRC The issue, to decide for or against permission for low-power operation; but rather, under what conditions the NRC should reasonably exercise this power.
In this respect it is difficult for us to imagine that the Commission is unaware of the fundamental if not irreconcilable defects and deficiencies attending the Shoreham project, to wit:
The safety concerns inherent in the plant's outmoded design and faulty construction.
The plant's geographic location and the resultant inability to safely address the requirement of off-site emergency preparedness.

'Ihe loss of the regional economic base (through cost overruns) required to support the project.
The miscalculation of both electric need (faulty projections) and future generating sources (i.e.
hydro-power from Canada).
The recognized incompetance of the present LILCO management team.
As you conclude, John, the Commission's avoidance of the doctrine of
" reasonable assurance" that these issues can be resolved, may be construed as an abdication of responsibility--considering the gravity of the consequences that could result from the NRC's action--and therefore, a dereliction of duty.
It is one thing to employ " statutory discretion" but to do so with little or no apparent regard to the critical data involved appears to be arbitrary and capricious if not malfeasant.
Finally, it is our considered opinion that malfeasance and dereliction, though possibly inferred in these circu= stances is only an inference and one that can be expected to result from the admixture of the two separate and irreconcilable roles of " advocate and regulator" in the one agency.
John, I hope you will persist in your present course of action until public opinion and the courts, if necessary, provide the motivational force required to restructure and redirect the NRC toward the exclusive goals of regulation in the interest of the health, safety, and economic needs of U.S. citizens.

THE FEDERAL EMERGENCY MANAGEMENT AGENCY (FEMA) SUPPORT FOR THE NUCLEAR REGULATORY COMMISSION (NRC) LICENSING OF SHOREHAM NUCLEAR STATION As promised in my December 22, 1983 memorandum to you, I am transmitting herewith one copy of the Long Island Lighting Company's Revision 3 to the LILCO Transition Plan for Shoreham.
LILCO informs us that they have transmitted 15 copies of Revision 3 to your Regional RAC Chairman.
LILCO has also stated that this Revision does not make significant changes but rather sets forth matters of modification and clarification.
We thank you for your continued support and look forward to receiving your report on February 1, 1984 as previously agreed.
