Dear Congressman Carney:

Thank you for your letter of August 11,'I982~edctosing-correspondence from your constituent, Mr. Gerry Boneske, in which Mr. Boneske asks for a

" fair hearing" for the Shoreham nuclear power station. ~

The public hearing now underway at Shoreham is being coriducted by a three-person, independent Atomic Safety and Licensing Board (ASLB).

The Board is expected to conduct its hearings in accordance with rules of practice designed to assure a full and fair review.

However, as added assurance, provision is made for appellate review of the ASLB proceeding by an independent Atomic Safety and Licensing Appeal Board, whose review, in turn, may be reviewed by the Comission itself.

Ultimately, the Comission's final decision may be subject to review by the courts to assure compliance with the Federal Administrative Procedure Act and the Comission's authorizing statutes.
