Thank you for providing me with a copy of the comments to the Shoreham Comis-sion report which you, Bill Ronan and Fred Kahn prepared.
In that the NRC has concluded that it would be inappropriate for it to vote or otherwise adopt the-Comission's final report, we will not be taking an official position with regard to your comments.
However, I did want yon to know that I felt that the views expressed by each of you were very helpful in providing a better under-standing of the issues addressed by the Comission and that they contributed
'substantially to a more balanced presentation of the facts.
Two observations may, however, be of assistance.
In reviewing the document attached to your comments entitled "Shoreham Comission", I did observe one statement on page 9 which you may wish to modify somewhat for accuracy. On that page you state that " studies currently being conducted by the NRC are studying the future contraction of the emergency planning zone from the current-ten-mile requirement to two miles".
In fact, the emergency planning proposal now being considered by the-NRC Staff does not propose to reduce the present ten-mile' emergency planning zone, but rather, adds a requirement for prompt evacuation within the first two miles of the reactor. The Staff's proposal does provide, however, that while evacuation beyond the two-mile zone is unlikely, it cannot be entirely ruled out for ususual accident sequences or particularly adverse meteorology.
The second point which you may wish to consider is Fred Kahn's statement on-page two of his " Conclusions" to the effect that it is a " ridiculous process L
by which opponents to the location at Shoreham were told that the siting decision was not the proper forum for weighing their objections, but that instead they would properly be considered after the plant had been constructed".
While I understand the point Fred is addressing, in fact, the question of D
location was considered at the construction permit hearings in 1970. The issue i
that was delayed for final consideration at the operating license stage was-emergency planning. Your comments addressing the necessity for this delay (paragraph 5, page 4) do, I believe, clarify this concern.
