The Nuclear Regulatory Comission staff is proposing to fine the l

Sacramento Municipal Utility District (SMUD) 1100,000 for alleged violations of NRC requirements involving control of radioactive liquid effluents at the Rancho Seco Nuclear Generating Station, located 25 miles southeast of Sacramento, California. NRC Regional Administrator John B. Martin notified the District of the alleged violations by letter on January 13.

The alleged violations have been the subject of extensive Federal review since mid-1986, and are considered by NRC to demonstrate past poor performance, rather than current performance', at Rancho Seco. The NRC recognize that the effect of the radioactive releases was not.significant.

During an inspection conducted April 1 through May 23, 1986, NRC inspectors found that SMUD:

1) as of April 1,1986, failed to establish an adequate surveillance program to provide dat'a on quantities of radioactive material released in liquid effluents;
2) from January 1983 through May 6,1986, implemented procedures and temporary modifications in the processing and release to the environment of radioactive water without the required Technical Specification and safety review, and without required documentation; 3)onJune4. June 6,cndJune 17, 1985, identified measurable concentrations of the radioactive nuclide Cesium 137 in samples of radicactive liquid wastes to be discharged, but did not report these con.entrations as required; l
4) during calendar year 1985, released _ radioactive materials in liquid effluents such that a member of the public could have received a total l

body radiation dose of approximately 3.9 millirem, exceeding the 3 millirem regulatory 1imit;

5) from March 30, 1983, to January 6,1986, and from March 6 to March 30, 1986, failed to implement required procedures and to maintain necessary control of liquid radioactive waste handling and discharge to the environment; and, (more) yox en e m

Severity Level III problem, with Level I being the most serious and Level V the least serious.

The base civil penalt, for Severity Level III is $50,000. This penalty was increased to $100,000 Decause of the duration of the violations and the significant breakdown in management control of the radioactive effluent discharge program. During review, the NRC staff considered all the infonnation provided by SMUD on these issues, their relative age, and the comprehensive corrective actions taken by the District prior NRC authorization of the restart of Rancho Seco on March 30, 1988.

SMUD now has 30 days to submit a written statement to the NRC admitting or denying the alleged violations, explaining the reasons for them if admitted, stating the corrective actions which have been or will be taken and the date when full compliance was or will be echieved.

The District also has 30 days to pay the proposed fine or to protest it, in whole or in part.

If the fine is protested and later imposed, SMUD may request a public hearing.
