Dear Ms. Toensing:

Enclosed is a Report of Investigation concerning Material False Statements made to the U.S. Nuclear Regulatory Comission (NRC) by officials of the Sacramento Municipal Utility District (SMUD) and Rancho Seco Nuclear Generating Station (RANCHOSECO).

The Investigation revealed that in 1985, radioactive liquid effluents had been released from RANCHO SECO in excess of regulatory limits. The SMUD Assistant General Manager, Nuclear, reported in required Semi Annual Liquid Effluent Release Reports submitted to the NRC that releases had not exceeded regulatory limits. Chemistry and Radiation tests were manipulated to reflect that radioactive nuclides were not present in liquid effluent releases, when in fact nuclides were present at levels that required documentation. The RANCHO SECO design and operation was also modified in such a way that allowed radioactive water to be transferred from the primary system radioactive water.

The plant modification and manipulations of Chemistry / Radiation tests were discovered by NRC Region V Inspectors during an unannounced inspection. The matter was then investigated pursuant to a Request for Investigation from the NRC Region V Administrator.

In light of the evidence of possible Federal criminal violations, this Report and exhibits are being forwarded to you for whatever action you deem appropriate.
