RESPONSE TO ATOMIC SAFETY AND LICENSING BOARD ORDER Public Service Company of Oklahoma, Associated Electric Cooperative, Inc., and Western Farmers Electric Cooperative hereby submit the Affidavit of John B. West, Ph.D., in response to the Atomic Safety and Licensing Board's Order to provide "a document describing the nature and extent of site preparation already undertaken and of restorative measures, if any," that are proposed. This affidavit is being filed pursuant to the Licensing Board's Order of April 29, 1982.

Dr. West states that it is intended to preserve the Black Fox site for the construction of future power generation projects, and that a decision will be made by the end of 1982 regarding the form of such future projects (West Affidavit, 9 3). Dr. West also delineates the various site activities h

undertaken pursuant to the authority of the Limited Work Authorization, as amended ("LWA"). In addition, Dr. West explains that each and every facility and other improvement made at the site under the LWA could well be useful as a part of a future power generation facility. In this circumstance,

Dr. West concludes that no facility dismantling or other site redress should be undertaken at this time.

Based on the plan discussed in Dr. West's affidavit, Public Service Company of Oklahoma, Associated Electric Cooperative, Inc., and Western Farmers Electric Cooperative believe that a final judgment on site redress should be held in abeyance pending a decision by the end of 1982 concerning the nature and course of future power generation projects.

Further, it is believed that the future course of events in this matter should be assigned to the NRC Staff as a part of their normal regulatory responsibilities. Therefore, Public Service Company of Oklahoma, Associated Electric Cooperative, Inc., and Western Farmers Electric Cooperative request that the Licensing Board grant their Motion for Termination of Proceeding and Withdrawal of Application subject to the condition that Public Service Company of Oklahoma, Associated Electric Cooperative, Inc., and Western Farmers Electric Cooperative submit, within a reasonable time after the end of

1982, a plan which addresses the need for site redress con-sistent with the future use determined for the site; and that said plan be subject to the review and approval of the NRC Staff.
