MOTION FOR LEAVE TO FILE OUT OF TIME Public Service Company of Oklahoma, Associated Electric Cooperative, Inc. and Western Farmers Electric Cooperative (" Applicants") hereby move the Atomic Safety and Licensing Board (" Board") to enter an Order extending the time within which to respond to the Board's January 7, 1983 order by two days. In support of the Motion, Applicants state:

1. The Board's January 7 Order requested information of Applicants by January 21, 1983. Applicants' response to this request is being filed on January 23, two days late.
2. Notwithstanding the date of the Board's Order, it was not receired by Applicants' Washington counsel until January 13, 1983, six working days prior to the January 21 8301250604 830123 PDR ADOCK 050005gg G

deadline. Dr. West immediately undertook to complete his affidavit, and it appeared to Applicants' counsel that despite the short time involved and lead counsel's conflicting commitments, it was feasible to make that deadline. Hence, no motion for a time extension was deemed necessary.

3. Applicants' lead counsel had scheduled prior to January 13 meetings with various witnesses from Westinghouse Electric Company and Commonwealth Edison Company for review and consultation of their draft testimony concerning the pending operating license application for the Byron Station. This task took counsel to Chicago on January 14, Pittsburgh on January 17 and 18 (with a stop in Jackson, Michigan on the 19th to discuss a pending matter involving the expansion of the Big Rock Point spent fuel pool). Meetings with Westinghouse and Edison witnesses in Washington were resumed on January 20 and 21.

It was expected that this activity would end sufficiently early on January 21 to permit the timely filing of Applicants' Motion responding to the January 7 Order. In fact, these meetings did not end until Saturday, January 22. Thus Applicants' Motion is being filed on the next available day, January 23.

4. No other party will be prejudiced by the grant of this Motion.

v For the foregoing reasons, the Motion should be granted.
