A.

Purpose:

Periodic reminder of each employee's obligation to be familiar with and adhere to the requirements of 10 CFR 0, Conduct of Employees, as implemented by NRC Manual Chapter 4124 B.

Discussion:

Part 0 covers such areas as acts affecting a personal financial interest; future employment (including solicitation, negotiation, or arrangements

-for private employment by an employee who is acting on behalf of the NRC in any particular matter in which the prospective employer has a financial e

interest); receiving salary from a source other than the.overnment; disqualification provisions pertaining to former employees in matters connected with former duties or official responsibilities; confidMtial statements of employment and-financial interests, gif ts, entertainment, and favors; scandalous conduct in a variety of areas; ano ex parte contacts.

C.

Action:

There are serious consequences attached to any violation of Part O.

The best way of avoiding a problem is if each employee would periodically review his or her personal copy of HRC Manual Chapter 4124 which includes 10 CFR 0.

Additional copies of the manual chapter may be obtained from the Personnel Staff. Each employee should also plan to attend.one of the upcoming training sessions on the subject of employee conduct and conflicts of interest.

. a By memorandum of September 19,1984, the ED0 established as policy the proposed NRC Manual Chapter 05017. " Management of Allegations." Paragraph 058 of Chapter 0517 describes the way in which of licensees or other effected organizations should become involved in the handling of allegations. As stated, allegations not concerning a potentially significant or imediate impact on public health and safety are to be evaluated for referral in writing to the appropriate licensee, applicant, or vendor. The letter of referral will request that the organization address the allegation and take any necessary j

corrective action as a result of its findings. This NRC referral is made to conserve NRC resources. To implement the referral policy, Region IV established Regional Office Notice No.1105(1) (Enclosure 2a). As stated in the office l.

On page 4 of Mr. Kelly's testimony, he states "For a two month period, I surfaced allegations of numerous security violations to include a nusber of incidents indicating drug or alcohol use at the utility site... Since the NRC has no regulatory standards applicable to alcohol and drug problems, the matters were turned over to the utility for action. The NRC took no regulatory action of.any type, even after these incidents were brought to its attention."

The remainder of this enclosure addresses this matter in more detail.

During NRC Inspection 50-298/85-23 conducted during the period July 29 through August 2 and August 12-16, 1985, sixteen allegations were identified by the NRC inspector during interviews with Nebraska Public Power District (NPPD) personnel.

At the direction of Region IV management, on August 2,1985, the NRC inspector related these allegations to the NPPD investigator with a request to perform follow-up investigations. The allegations pertaining to drug and alcohol abuse and management control were turned over to the licensee for investigation and corrective action. At this time, the licensee did not have a comprehensive fitness for duty program. The finalization of the industry guidance for a fitness for duty program did not occur until August 1985. The remaining allegations pertained to vital area barriers and reportability, and these were identified as unresolved items in NRC Inspection Report 50-298/87-23, referred to NRC's Office of Investigation, and addressed in NRC Investigation Report 85 016. NRC Region IV is presently evaluating these matters for escalated enforcement action.

By letter to Region IV, dated August 16, 1985, and April 23, 1986, the licensee identified corrective actions to be taken to address these allegations. In response to prompting by Region IV management, the licensee instituted management changes in the security organization, upgraded training of security personnel, revised and upgraded security plan procedures, expanded quality assurance surveillance in the security area and conducted urinalysis drug screening of the guard force. In addition, several interim security measures were put into effect immediately while long ters corrective action to the Cooper Nuclear Station (CNS) security program was in progress. Region IV has continued to evaluate the progress and effectiveness of the CMS security system and to monitor the fitness for duty program implemented by the licensee in January 1987.

electrician who was previously retained by NPPD. The electrician became-L intoxicated off-site er.e day and was involved in an embarrassing situation.

Mr. Kelly recalled abwt this event the following:

...it was never reported to-the NRC...

NRC took no conclusive regulatory action...the electrician was fired rather than reing provided with counseling..."

It is true that the licensee did not report the matter to NRC; however, the event, which occurred on July 21,1985 is not required to be reported by the current Commission regulations. It is also true that the contract electrician was released rather than being counseled. This was because no NPPD counseling benefits apply to contract personnel. However, with regard to the coment that NRC took no conclusive regulatory action, some clarification is warranted.

After evaluating this event, the NRC cited the licensee for failure to adhere I

to the CNS physical security plan as it related to personnel reliability and the granting of unescorted access to vital areas. The Notice of Violation and I'

Proposed imposition of Civil Penalties on this matter was issued on April-28, In the 1986.. In the NPPD response to the violation, this issue was contested.

-subsequent _ Region IV-recommended draft imposition order, it was proposed that the agency continue to support the violation, but Region IV also highlighted to the Office of Inspection and Enforcement (IE) that the matter was related to fitness for duty requirements.

Upon further review by IE, the violation was withdrawn by NRC. In spite of the fact that we retracted the violation, we believe that the licensee clearly benefited from knowing our concerns related to employee fitness programs.

its-inspectors, up.to 50 in number who visit the Cooper site, to voluntarily take Cooper's drug test."

The Cooper Nuclear Station fitness for duty program applies to all individuals-J requesting unescorted access to the site, including NRC employees, effective June 18, 1987. With the knowledge that NRC's own fitness for duty program-would not be established by that date and with E00 approval, Region-IV management issued an office notice (Enclosure Sa) on May 19,1987, informing employees of the applicability of the licensee's program and providing guidance to inspectors requiring access to the site. This issue was also' subsequently discussed with the Region IV inspectors in technical meetings. The following p

paragraph quoted from the office notice contains the full statement of guidance provided to Region IV employees and stresses the discretionary nature of that guidance.

Puroose:

To inform the Region IV staff of the applicability to regional personnel of the NPPD Fitness for Duty Program which was promulgated pursuant to a June 25 1986, Cosmission policy statement on fitness for duty of nuclear powerplantpersonnel.

B.

Discussion:

TheNPPDNuclearPowerGroup(NPG) Directive 2.3,hisdirective,"NP6 Fitness for Duty Program" was effective December 18,1986. Under t unescorted access to Cooper Nuclear Station (CN5) can only be granted to an individual who is subject to the program and has successfully passed-the prescribed drug and alcohol screening tests.

One provision of the NPPD program otates that NRC employees who require unescorted access to Cooper Nuclear 9tation shall pass the drug and alcohol tests required by the directive or pass 'a comparable test conducted by the NRC and a) proved in writtag by the District. NPPD delayed applicability of tte drug and alW1 testing provisions to 1987, for NRC employees to allow NR.' ties to implement a June 18,le drug screening program. Executive 9rder 12564, ' Drug. Free comparab Federal Workplace," mandated each Executive Agtecy to develop a plan for achieving the objective of a drug-free workplace with due consideration of the rights of the government, the employee, and the general public. Such a program is currently under consideration by the Commission. However, that the NRC mgram will not be taplemented by June 18. 1987. Thus, guidance for legion IV employees requiring access to the CBS site is necessary and follows in section C.

1 On June 11,1985, NRC received a ten-part allegation regarding the Public Service Company of Colorado (PSC) fitness for duty program at Fort St. Vrain (FSV). Specifically the alleger expressed concerns related to the qualificationsofaIeadmemberofthesecurityforceforreasonsof alcoholism, sexual improprieties among members of the security force, theft'or misuse of PSC property, and use of illegal drugs at FSV. The alleger. stated to

Moreover, the alleger stated that the accused person was erratic and violent, and that the alleger feared not only for the personal safety of i

In view of these statements and the additional perspective of the security inspectors,' the involved Region IV management and inspection staff believed that the alleger had justification for being concerned about personal well being. Discussions with the security staff who had police experience and with the Regional Counsel persuaded the Regional Administrator that NRC could not Local law provide or assure physical protection for the alleger or the child.

The Regional Administrator pointed out to the Vica President that he could place the man's job in jeopardy if any threatening behavior took place: a deterrent the Regional Administrator judged to be more effective than what the NRC had available to it. A copy of our referral went into our allegation case file and there was no other formal distribution of.the letter of referral by NRC. Such control of what we believed to be sensitive information was effected in order to minimize the potential for jeopardizing the alleger (PSC was not told the identity of the alleger, but the issues were likely to establish that. identity) and maximizing the utility's ability to discretely investigate the concerns.

We understand that this was NRC's first opportunity to refer an allegation to f

PSC for their resolution. Subsequently, we found that the utility was unprepared to perfom such an investigation and, as a result, follow-up efforts were inadequete from Region IV's view. We do understand though that no ham I

The utility's ability to successfully deal with this matter were also frustrated by the involvement of-l two senior PSC managers (including the Vice President of Electric Production) i in alleged illegal activities that subsequently resulted in their separations According to from the utility prior to being charged with criminal activities.

It did, obviously though, detract from their ability to resolve the alleger's concerns in a timely manner. l On cage 10 of Mr. Kelly's testimony, the following statements are made "...an operstor at Fort St. Vrain, who is responsible for maintaining safety systems, was reported to have been under the influence of drugs. This matter was taken out of the hands of the NRC's Security Personnel and again referred for action =

to the utility... Nor am I aware of any action taken by the utility..."

Inasmuch as the resolution of this matter was not assigned to the NRC's security personnel, clarification of the issue and 'the utility's resolution of issue are needed. The individual who was alleged to have been under the influence of drugs was not an operator, but rather a maintenance supervisor who.

is a licensed fuel handler. The licensee received our-letter of referral on May 12, 1987. As discussed in the licensee's letter to NRC dated June 1, 1987, on May 20,1987, the subject of the allegation was removed from unescorted access privileges to the FSV site, The individual submitted to urinalysis and the results were negative for all drugs. Also, the. individual was i

professionally evaluated for alcohol or emotional problems, and the results were that no evidence was found of alcohol dependency or mental instability.

We understand that throughout this investigation the individual offered total cooperatica with the utility. Consecuently, on May 22, 1987, the individual was reinstated with unescorted access to the FSV site.

Although the NRC program for dealing with allegations is a resource savings for NRC and does bring to our attention valuable information that might not have othenvise been found by MRC inspectors, thes e are occasions when the information received is unfounded. Such is the case at hand. Nevertheless, the acticns taken by PSC are viewed as responsible, and now the results of this allegation will be assigned to and reviewed by NRC's security personnel in order to assure that the stated actions by PSC were accomplished in accordance with the FSV security plan.

The following quotation is from page 11 of Mr. Kelly's testimony:. "When a plant is under construction the NRC lacks jurisdiction over security matters regarding those working on the plant."

A plant that receives a construction permit is required to have in place a-quality assurance program to be applied to the design, fabrication, construction and' testing of the safety related structures and components to ensure that they will perform as fequired. There are no NRC regulations in effect during this period that govern security matters, but many constructi(a permittees and their contractors have implemented programs in an attempt to provide a drug free / alcohol free work place. The plant security program'is usually innlemented 15-30 days prior to the construction permittee receiving an operating license, and the NRC regulations governing this program go into effect when the license is issued.

The following is an excerpt from page 12 of Mr. Kelly's testimony. " Efforts-are under way in the industry to allow for a relaxation of security requirements at plants during the outage phase."

Security plans for some recent plants have included a provision to allow for a.

devitalization of selected vital areas during outages if certain plant conditions-are satisfied-in order to facilitate outage activ.ities. These

-security plan provisions have been authorized by NMS$ reviewers with NRR concurrence after a review of the governing plant conditions and the confirmation by them that all safety related systems and equipment affected by the devitalization will be operationally tested prior to plant start up. For those Region IV plants with devitalization provisions in their security plans, the fitness for duty program and the protected area access requirements remain in effect.

the NRC did not pursue the matter citing the lack of a regulatory basis." This quotation is correct from strictly an NRC enforcement point of view. However, in actuality, Nebraska Public Power District (NPPD) middle management at CNS did cooperate with Mr. Kelly and the local Sheriff in addressing this issue.

At the time that this' incident occurred in early 1985, NpPD had yet to implement a strong fitness for duty program; consequently, we were disappoirted with the utility's lack of investigative knowledge and we would have preferred more cooperation from the interim plant manager. Nevertheless, the individual who was alleged to have been offering cocaine for sale is no longer retained as a contractor at the CNS site.

STANDARDS OF CONDUCT REQUIREMENTS APPLICABLE TO EMPLOYMENT NEGOTIATIONS Under NRC standards of conduct requirements, an NRC employee.is not to solicit employment from or negotiate employment with any prospective private employer who has a financial interest in any_ matter, including adjudications, contracts, and rulemakings, on which he or she is acting as an NRC saployee.

" Solicitation" by an NRC employee encompasses any contact with a particular potential employer, including a telephone call or the submission of a letter of inquiry or a resume, that reasonably can be construed as indicating an interest in obtaining a position with that employer.

Such " solicitation" ends only when the NRC employee affirmatively withdraws the employment inquiry or concludes negotiations without accepting employment or when the potential employer informs the NRC employee that employment is not available.

An employee aunt inform his or her supervisor prior to nolicitina employment with any entity that has an interest in any matter that the employee is working on or han responsibility for.

This is necessary so that arrangements can be made to have the employee screened f rom any involvement with that matter pending the end of the solicitation / negotiation process.

However, an NRC employee is not obligated to inform his or her supervisor about a solicitation so long as the employee is not working on or responsible for matters affecting the potential employer.

If an employee has any questions about whether screening may be necessary in a particular instance, ha or she should consult with the office of General Counsel.

If a prospective employer contacts an NRC employee to ascert6in his or her interest in a position, he or she should not have any dealings with matters affecting that potential employer until the employee rejects the solicitation.

The employee should inform his or her supervisor immediately if removal from existing duties is necessary.

In the event an offer is accepted, the employee should not work on any matter affect:-9 that entity until NRC employment is terminated.

If, on the other hand, an employee's solicitation is refused or withdrawn, the employee generally is free to resume dealing with matters affseting the entity.

As a general matter, the regulwary requirements detailed above do not apply to an employment solicitation to another federal

entity, However, special problems may arise if the potential employer is a federal entity that is an NRC licanbe applicant or a licensee ( n, the Tennessee Valley Authority or the Department of Energy) for which the employee has regulatory responsibilities.

In such instances, employees should contact the office of General Counsel prior to soliciting employment from those federal entities._.

Almost daily, Deputy Ethics Counselors in the Office of General Counsel receive telephone calls-and written requests for advice on conflict of interest matters from current and former agency i

employees.

We welcome such requests.

It is in the interest of the agency and the employee that potential conflict of interest situations be resolved before there has been a violation of the various legal requirements in this area.

Your knowledge and understanding of these requirements is the key to early identification and resolution of potential conflict problems.

To aid you in identifying potential conflict problems, we are distributing with this memorandum a booklet entitled 'How to Keep out of Trouble."

This booklet, which was prepared by the office of Government Ethics, contains a brief summary of the government-wide ethics requirements.

You should retain it as a ready reference for answering general questions.

In addition, please review carefully the more detailed outline of major agency conflict of interest j

requirements that follows.

Financial Disclosure Reports Within the past several months, many of you have submitted a Confidential Statement of Reployment and Financial Interests (NRC Form 269) or a Financial Disclosure Report (Form 270).

This office j

has completed its review of these statements.

We have written individual letters to those of you who have stockholdings and/or outside employmcat that could present a r:onflict of interest or appearance of impropriety.

These letters remind-you not to participate in matters affecting those organisations.

Generally, organisations listed in the letters, while not entities placed on the prohibited securities list discussed in Part II of this announcement, nonetheless are engaged in activities in the commercial nuclear field or have, or potentially may have, business _

State or local governments, if the primary purpose of the security is to finance the construction or operation of a nuclear reactor.

Architectural-engineering companies that have (1) been engaged by an applicant for a construction permit or for an operating license to provide services relating to a nuclear facility, or (2) filed a standard reference design that is under commission review or has been approved by the commission and currently is effective.

Approval for Port-Time Employment by Outside Entity Full-time Commission employees require written authorisation before accepting any employment, fee, or compensation from Commission licensees (including universities), license applicants, organisations directly engaged in activities in the commercial nuclear field, Commission contractors, Agreement state licensees, nuclear trade associations, Commission suppliers or lav firms, or other organisations that are participating in an NRC proceeding or that tegularly represent themselves or clients before the NRC.

Employees who work for offices reporting to the commission through the Executive Director for operations (BDO) must receive written approval from the EDO.

Employees working for offices reporting directly to the Commission must receive written approval from their office director.

The procedure for obtaining approval is spelled out in NRC regulations, 10 C.F.R. 0.735-40(b).

Reimbursement for Travel Expenses by Outside Entity Written authorisation from the EDO or, in the case of Commission-level offices, the office director also is required before an employee may accept payment (1) for official. travel expenses from any outside entity or (2) for travel expenses unrelated to official business from any outside entity within the

With regard to reimbursement for official travel esponses, such reimbursement from L

an outside entity to an NRC employee is appropriate only it 1.

The travel is incident to training at a non-Government facility or attendance at a meetings and 2.

The donor is a nonprofit, tax-exempt institution described in 26 U.S.C. $ 501(c)(1).

In addition, the relationJhip of the donor organization with the agency and the individual employee must be scrutinized to ensure that no actual or potential conflict of interest is involved.

Similar scrutiny is necessary for any travel reimbursement from a donor to an NRC employee who is not on official business.

NRC employees also should be aware that acceptance of expenses for unofficial travel from a foreign government or its agent may constitute a violation of the Foreign Gifts and Decorations Act.

Whether an employee can accept travel expenses from anyone outside the agency (including foreign governments or international organizations) can be a complex question.

Any employee contemplating doing so should apply for permission in accordance with the app: oval procedure in 10 C.F.R. 0.735-40(b) as far in advance of the travel date as possible to ensure that any conflict r

of interest problems can be avoided.

VI.

Gifts NRC employees are precluded from accepting any gift, gratuity, favor, meal, or any other thing of monetary value from Commission licensees and others regulated by the Commission, with a few exceptions that are spelled out in 10 C.F.R. 0.735-42.

Food and refreshments may be accepted from applicants, licensees, I

contractors, or vendors only on infrequent occasions in the ordinary course of a luncheon or dinner meeting or other meetings or on an inspection tour where an employee may properly be in attendance.

In many cases reimbursement will be required.

When questions arise, employees should contact OGC.

Under the Foreign Gifts and Decorations Act, employees are able to accept gifts from foreign governments presented as a souvenir or mark of courtesy, provided the value of the gift does not exceed

$165.00.

Pas _tessleymen.t Mestrictiorg OGC frequently receives questions regarding the restrictions on contacts with the agency by former NRt employees.

The restrictions imposed by the Ethics in Government Act fall into three categories:

(A)

There is a permanent b4a on acting as another potson's representative (basically making any written or oral communication with intent to influence the Federal Government) to the Government on any case, contract, application, or other particular matter involving a specific party if the former employee participated

' personally or substantially* with regard to the matter while employed by the NRC.

(B)

There is a two-year ban on such representation with respect to those particular matters involving specific parties that actually were pending under the former l

employee's ' official responsibility' within one year prior to termination of that responsibility.

(C)

Most employees classified as SEs or GG-17 or above are subject to more restrictive conditions, including (1) a one-year ban on contacting the NRC with intent to

'nfluence agency action on any matters pending before, or

.af substantial interest to, the agency, as well as (2) a two-year prohibition on giving assistance in the i

representation of anyone other than the United states if that ssaistance involves personal presence at any formal or informal appearance and is in connection with any particular matter involving a specific party in which he or she participated personally and substantially while a government employee.

The Executive Director for Operations may exempt a former employee from these restrictions to permit the individual to communicate scientific or technological information to the NRC.

Detailed regulations on how to secure the EDO's approval have been established by the Commission.

VIII.

Examples of Conflict of Interest situationa For your information, we provide the following summary of some OGC conflict of interest advice that we have given in recent months.

(The facts have been changed slightly for illustrative purposes.)

1.

A recently married employee's spouse owns prohibited stock.

We advised the employee that divestiture of the stock should take place within six months.

(Determinations regarding the appropriate divestiture time for securities acquired involuntarily, such as through inheritance or marriage, are made on a case-by-case basis.)

The employee also was advised that until divestiture took place, she could not participate in matters affecting that company.

3.

One of the terms of an agreement for the sale of an employee's car to his branch chief was the employee's acceptance of his supervisor's promissory note for

$2,000.

We edvised the employee and the supervisor that this loan arrangement required the prior written approval l

of their division director.

l 3.

An NRC employee was invited to a holiday cocktail party hosted by a reactor vendor.

The employee was told that l

he could attend but he should reimburse the vendor for the reasonable price of any food or beverages consumed.

4.

An NRC employee stated that he visitd to negotiate for employment with an NRC licensee.

We advised the employee that once he submits a resume to the utility he is precluded from working on matters for the NRC affecting that licensee.

If negotiations ended unsuccessfully, he could resume working on matters affecting that company.

If the employee's WRC job required him to work on matters affecting the licensee, he should inform his supervisor prior to soliciting employment so that screening arrangements can be made.

On the other hand, if his NRC work did not involve matters affecting the licensee, he was under no obligation to inform his supervisor that he was negotiating for employment.

A university with an NRC materials license asked an NRC employee to give a lecture at the university on his own time on a subject not telated to the agency or its l

The university offered the employee an honorarium.

l could deliver the lecture and accept the honorarium from the university if he received prior written authorisation from the EDO.

6.

A nonsupervisory NRC employee accepted employment with a j

utility he had inspected.

We told him that his prior NRC employment did not restrict his activities for the utility, except that he could not repressnt the utility l

before the NRC on any enforcement action in which he participated while an NRC employee, or on any inspection report he had helped to prepare during his NRC tenure.

I 7.

An employee with health physics training was requested by i

his Army Reserve unit to aid in safety reviews related to military use of certain nuclear materials that are the subject of an NRC. license.

We advised the employee that he should decline to do so.

His activities could place the agency in the position of having to review the on'; side work of its employee, thereby creating questions about impartiality and preferential treatment.

8.

An NRC employee formerly employed by a nuclear utility was asked by that utility to appear as a witness in litigation against its architect-engineer.

The lawsuit and the testimony sought from the employee involved a contract dispute that did not raise any nuclear regulation or other issues of interest to the federal government.

The employee was advised that he can appear on behalf of the utility if under a subpoena, but that any compensation must be limited to per diem en$

transportation expenses provided by law for subpoenaed witnesses.

9.

An office supply company in which an NRC employee is a partner wanted to submit bide for certain contracts with the federal covernment.

We advised the individual that because he is a federal emplofee he should not be involved in representing the partnership before the i

federal government with respect to the bids and that, if the contract was awarded to his company, he cannot make any representational contacts to the government on behalf of the company or receive any partnership profits derived from the contract.

10.

An NRC employee wished to act as her parents' representativ? to the Internt1 Revenue Service regarding certain incomo tax matters.

The employee was advised that, although she is a federal employee, she can represent her parents in this matter before another federal government department so long as she obtains the EDO's written authorization.

On Tuesday, October 18, 1988, I met with Mr. William L.

Counsel, and the Commission's deputy ethics counselor for Region IV located in Arlington, Texas, to discuss ethics and standards of conduct activities in the region and to review the confidential reporting system.

The Commission was created by enactment of the Energy Reorganization Act of 1974 and officially began uc rations in 1975 as an independent agency.

The Commission has 'iv a Commi,tsioners who are nominated by the President and confirmed by the Senate.

The Chairm d of the Commission is appointed by the Presiden from the five Commissioners.

Simply stated, the Commission's overall mission is to assure that non-military applications of nuclear materials in the nited States (medical, industrial and research) are conducted with appropriate consideration for the protection of the public health, safety and the environment, the safeguarding of nuclear materials and facilities, and the safe transportation of I-nuclear materials.

responsibilities through a program of licensing, inspection and t

Region IV covers 14 states (Arkansas, Louisiana,

Texas, Oklahoma, New Mexico, Kansas, Colorado, Utah, Wyoming, Nebraska,
Idaho, Montana, North Dakota, and South Dakota).

It is the largest of the Commission's regions in geographic area.

Aboot 180 persons ars employed by the region.

About 25 to 30 employees are located at the Denver, Colorado Uranium Recovery Field Office.

The Denver office oversees uranium milling operations which are regulated by the Commission.

The majority of the region's employees are engineers who are assigned as on-site inspectors at nuclear power facilities or region based inspectors vho assist at Various locations.

Mr. Brown is responsible for the confidential financial reporting system and the

training, advising, and I

counselling of employees on conflicts of interest matters and the standards of conduct.

The standards are supplemented by l

l the Commission's Inspection and Enforcement Manual, Chapter 0200, which provides more detailed information for resident inspectors i

According to Mr. Brown, resident i

inspectors work in a unique environment.

They are assigned to the l

nuclear licensee plants and generally live in communities located near the plant which are frequently populated with many licensee l

Because of the nature of this environment, inspectors are briefed on restrictions regar' ding such things as attendance at 6

l neighborhocd social functions, carpooling, and the joining of community or social clubs.

Spouses and dependent children are i

It could be said that because of the unique I

position of the inspector, the Commission's standards of conduct l

policy is applied more strictly to them.

For exemple, the Commission's standards at 10 CFR 0.735-42 (c) prohibit t.n employee from accepting free transportation from a licensee or ether person doing businnsa with the Commission when the acceptance might reasonably be interpreted as attempting to influence the impartiality of the employee or the Commission.

The approach is somewhat stricter with regard to inapectors in that they are flatly prohibited from even joining carpools with either licensees or contractor employees.

Employees subject to this prohibition must annually sign a L

If the employee does own a prohibited stock, it must be sold within a specified period.

The Office of General Counsel must be notified when the prohibited interests are sold. All certifications, as well as all confidential reports, are filed at headquarters.

In rare cases, exemptions to the restrictions on security ownership are available to employees.

For example, employees have been granted exemptions for vested pension plans in a prohibited company. OGC has reviewed many pension plans and has prepared a 1

list of those piens that have been approved. Basically, if it is determined that the amount that the employee is entitled to under the pension can't be affected by the company's performance, then an exemption will be granted, i
