REQUEST FOR PRODUCTION OF DOCUMENTS The NRC, through its attorneys, requests that Mr. Kelly produce the following documents: All written statements, records, notes, memoranda, or other documentation, including tape or other recordings, which pertain or relate in any way to any affinnative defenses that Nr. Bally intends to raise at the hearing on the above-styled case, or to any prohibited personnel practices or harmful procedural errors Appellant contends were committed by the agency. This includes, but is not limited to, claims of investigatory bias, incompetence or distortion; and retaliation, whistleblowing or disparate treatment.

It is requested that these documents be provided no later than 9:00 a.m., Friday, December 8,1989 at Room 1024, NRC Regional Offices. 611 Ryan Plaza Drive, Arlington, Texas 76011.
